Section 15. Reallocation of Position <br /> An employee in a position reallocated to a lower class shall have the right of either: (1) <br /> transferring to a vacant position in his/her present classification provided the department head <br /> into which the transfer is proposed agrees: or (2) continuing in the same position in the lower <br /> classification with their salary Y-rated. <br /> Section 16. Injury on Duty <br /> When an employee is incapable of performing his work or duties as a result of injuries received <br /> or illness arising in the course of his/her employment by the City and receives benefits pursuant <br /> to the Workers' Compensation Act, upon the sole discretion of the City Manager, a full-time <br /> competitive service employee hired pursuant to the merit personnel program may be granted a <br /> leave with an amount of pay equal to the difference between his/her City pay and the Workers' <br /> Compensation pay benefit, if any, received by him/her during such incapacity, but not to exceed <br /> one (I) year for any one (I) period of such incapacity. Salary continuation will be provided to <br /> employees injured on the job and unable to work for up to the first ten days of absence. Salary <br /> continuation beyond the tenth full day of absence will only be granted pursuant to the request <br /> procedure. <br /> Leave granted an employee under the above provisions shall not be considered sick leave or <br /> deducted from accumulated sick leave. <br /> When an employee has been injured in the line of duty and receives compensation in <br /> accordance with the provisions of any Workers' Compensation Act of the State of California, <br /> the ACM/designee shall have submitted to him/her reports on the forms in the manner <br /> prescribed. <br /> An employee injured in the line of duty who requires medical care and/or physical therapy shall <br /> schedule, as far as practicable, such appointments at a time so as to be as least disruptive to the <br /> work schedule. <br /> Modified Duty - It is the policy of the City to encourage employees to return to work as soon as <br /> possible. Every effort will be made to accommodate to an employee's medical needs to ensure <br /> a speedy return to work. An injured employee is required to cooperate and comply with request <br /> for information to facilitate the employees' return to work, either on a modified basis or a return <br /> to full duties. <br /> Industrial Disability Management Program - The parties agree to cooperate in the development <br /> of an industrial disability management program. <br /> Section 17. Hours of Work <br /> A work week shall be computed as the number of hours customarily considered as a full week's <br /> work in the classification and in the department in which the person is employed. <br /> Public Works employees who are regularly assigned to work a majority of their regularly <br /> scheduled shift between the hours of 4:00 p.m. and 12:00 a.m. (swing) shall receive a shift <br /> differential of one hundred seventy-five dollars ($175.00) per month. Public Works employees <br /> who are regularly assigned to work a majority of their regularly scheduled shift between the <br /> hours of 12:00 a.m. and 8:00 a.m. (graveyard) shall receive a shift differential of two hundred <br /> 13 <br />
