Kateri Harrison, 430-1/2 Breed Avenue, requested that the matter of <br /> Parcel Map 6628 be postponed for a month so citizens can discuss legal <br /> issues related to Measure D. She submitted a copy of a letter from Roy <br /> Gorman, Attorney for Citizens for Positive Planning. She said the <br /> Parcel Map is inconsistent with the provisions of Measure D because it <br /> is a Subdivision Map, as defined by the Map Act. She said a <br /> Categorical Exemption is inappropriate at this time. She said she did <br /> not receive notice that this item was scheduled for City Council <br /> consideration. She said the staff report does not refer to Measure D <br /> and there are no conditions of approval . <br /> E. Jeff Houston, 1465 Burkhart Avenue, spoke on behalf of the Sierra Club. <br /> He concurred with Ms. Harrison's statements and Mr. Gorman's letter. <br /> He said the public should have the opportunity to review the matter. <br /> F. Evelyn Plate, 1341 Belding Street, said the City Council should listen <br /> to people and comply with Measure D. <br /> G. Steve Meyers, City Attorney, said the matter on the Agenda is a Parcel <br /> Map dividing the total acreage into three parcels to permit financing <br /> for improvements for which Vesting Tentative Maps have been approved. <br /> He noted proposed language changes to the Resolution which state that <br /> the map is purely for financing purposes and does not permit any <br /> development. He said Measure D is in full force and effect, and it is <br /> staff' s intention to fully comply with it. He said his legal opinion <br /> is that the Parcel Map is different from a Subdivision Map under the <br /> Map Act and Measure D does not affect this Parcel Map. <br /> 6. CONSENT CALENDAR <br /> Consent Calendar items are typically routine in nature and are considered <br /> for approval by the City Council with one single action. The City Council <br /> may remove items from the Consent Calendar for purposes of discussion. <br /> Items listed on the Consent Calendar are deemed to have been read by title. <br /> The Consent Calendar was approved as follows: <br /> Introduced by Council Member Polvorosa, who moved adoption of the Consent <br /> Calendar, with all items deemed to have been read by title, seconded by <br /> Council Member Kerr, and carried by a majority vote (6) , with Council <br /> Member Galvan absent (1) . <br /> A.
