Minutes - San Leandro City Council Meeting - February 21 , 1995 Page - 9 - <br /> PUBLIC HEARINGS (continued) <br /> The following Motion was then introduced: <br /> Minute Order No. 95-7, Matter of A-94-11, Rezoning from RD (Residential <br /> Duplex) District to RM-1800 (Multi-Family Residential ) District; <br /> Rezoning of a 26-Unit Apartment Building; 433 Harlan Street; Harold G. <br /> Nelson, Applicant. (1099) <br /> On motion by Council Member Kerr, who moved its approval , seconded by <br /> Council Member Galvan, and carried by a majority vote (7) , the City <br /> Council approved A-94-11, Rezoning from RD (Residential Duplex) <br /> District to RM-1800 (Multi -Family Residential ) District; Rezoning of a <br /> 26-Unit Apartment Building; 433 Harlan Street; Harold G. Nelson, <br /> Applicant. <br /> B. Matter of Filing Eminent Domain Proceedings, Vacant Land Adjacent to <br /> 1010 East 14th Street, for the Root Park Urban Creek Project; W. C. <br /> Frost, Owner (authorizes the City Attorney to acquire subject property <br /> by eminent domain) . <br /> This being the time and place for the Public Hearing on the above <br /> matter, Rob Caughell , Engineering & Transportation Department, said the <br /> Resolution of Necessity authorizes the City Attorney to take Eminent <br /> Domain action to obtain the property and obtain legal title. He <br /> described the property and said the listed property owners are <br /> deceased. <br /> Council Member Loeffler provided information which might assist in <br /> locating the heirs. <br /> In response to questions, the City Attorney described the actions which <br /> have been and will be taken to locate the heirs, including the court <br /> process. <br /> The Hearing was then opened to the public. <br /> Lou Filipovich, 15376 Laverne Drive, made suggestions for locating the <br /> heirs. <br /> There being no further comments from the public, on motion of Council <br /> Member Perry, seconded by Council Member Loeffler, and carried by a <br /> majority vote (7) , the Public Hearing was closed. <br /> The following Resolution was then introduced: <br /> Resolution No. 95-28, Resolution of Necessity Determining That the <br /> Public Interest and Necessity Require the Acquisition of Certain Land <br /> and Directing the Filing of Eminent Domain Proceedings for Root Park <br /> Urban Creek Project - Assessor's Parcel No. 076-445-001-21 . (1206) <br /> Introduced by Council Member Polvorosa, who moved its adoption, <br /> seconded by Council Member Perry, and carried by a majority vote (7) . <br />
