Nelson, Applicant. (1099) On motion by Council Member Kerr, who moved its approval , seconded by Council Member Galvan, and carried by a majority vote (7) , the City Council approved A-94-11, Rezoning from RD (Residential Duplex) District to RM-1800 (Multi -Family Residential ) District; Rezoning of a 26-Unit Apartment Building; 433 Harlan Street; Harold G. Nelson, Applicant. B. Matter of Filing Eminent Domain Proceedings, Vacant Land Adjacent to 1010 East 14th Street, for the Root Park Urban Creek Project; W. C. Frost, Owner (authorizes the City Attorney to acquire subject property by eminent domain) . This being the time and place for the Public Hearing on the above matter, Rob Caughell , Engineering & Transportation Department, said the Resolution of Necessity authorizes the City Attorney to take Eminent Domain action to obtain the property and obtain legal title. He described the property and said the listed property owners are deceased. Council Member Loeffler provided information which might assist in locating the heirs. In response to questions, the City Attorney described the actions which have been and will be taken to locate the heirs, including the court process. The Hearing was then opened to the public. Lou Filipovich, 15376 Laverne Drive, made suggestions for locating the heirs. There being no further comments from the public, on motion of Council Member Perry, seconded by Council Member Loeffler, and carried by a majority vote (7) , the Public Hearing was closed. The following Resolution was then introduced: Resolution No. 95-28, Resolution of Necessity Determining That the Public Interest and Necessity Require the Acquisition of Certain Land and Directing the Filing of Eminent Domain Proceedings for Root Park Urban Creek Project - Assessor's Parcel No. 076-445-001-21 . (1206) Introduced by Council Member Polvorosa, who moved its adoption, seconded by Council Member Perry, and carried by a majority vote (7) .
