Minutes - San Leandro City Council Meeting - June 19, 1995 Page - 8 -
PUBLIC HEARINGS (continued)
B. Matter of Appeal by R. Barragan, X. Thomas, and J. Glass, Applicants,
of the Board of Zoning Adjustments' Denial of CU-95-3; Conditional Use;
to Construct a Triplex on a Lot-with Less=than-the Required, 100-Foot,
Minimum Width (75 Feet) ; 13170 Neptune Drive; Assessor's Parcel Number
79A-565-39-2; RM-1800 Multiple-Family Residential District.
This being the time and place for the Public Hearing on the above
matter, Kathleen Livermore, Associate Planner, presented the staff
report. She said the proposal is for a triplex on a lot with less than
100-foot minimum width. She said staff recommended approval ; however,
after reviewing the material and "listening .to testimony, the Board of
Zoning Adjustments voted to deny the Application. The denial was
appealed to the City Council .
Ms. Livermore described the former and existing zoning of the property
and the reasons for a Conditional Use permit. She said the Applicants
agreed to increase the front and back setbacks and decrease the lot
coverage. She said the proposal meets or exceeds all required
standards for RM 1800 zoning.
She said the BZA denied the Application because of public testimony
received at the Hearing. She summarized the reasons staff had
recommended approval .
In response to Council questions, Ms. Livermore said this is a
Conditional Use, not a Variance. The lot is considered substandard
because RM 1800 requires 100 feet in width, and the lot is only 75 feet
wide, so anything other than a single-family home requires special
approval .
Council Members Myers and Gal van and Vice Mayor Kerr described contacts
they have had regarding this project. All said it would not impact
their ability to make a determination in this matter.
In response to Council questions, Steve Emslie, Planning Manager,
described the scope of a Conditional Use permit in setting Conditions.
He said the issue is whether this proposal will support the General
Plan, be consistent with the Zoning Code, and not be deleterious to the
surrounding neighborhood.
Staff presented slides of typical designs by this architect, projects
in the surrounding area, examples of what the project would not be, and
other two-story elements on Neptune Drive.
The Hearing was then opened to the public.
