Glass, Applicants, <br /> of the Board of Zoning Adjustments' Denial of CU-95-3; Conditional Use; <br /> to Construct a Triplex on a Lot-with Less=than-the Required, 100-Foot, <br /> Minimum Width (75 Feet) ; 13170 Neptune Drive; Assessor's Parcel Number <br /> 79A-565-39-2; RM-1800 Multiple-Family Residential District. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Kathleen Livermore, Associate Planner, presented the staff <br /> report. She said the proposal is for a triplex on a lot with less than <br /> 100-foot minimum width. She said staff recommended approval ; however, <br /> after reviewing the material and "listening .to testimony, the Board of <br /> Zoning Adjustments voted to deny the Application. The denial was <br /> appealed to the City Council . <br /> Ms. Livermore described the former and existing zoning of the property <br /> and the reasons for a Conditional Use permit. She said the Applicants <br /> agreed to increase the front and back setbacks and decrease the lot <br /> coverage. She said the proposal meets or exceeds all required <br /> standards for RM 1800 zoning. <br /> She said the BZA denied the Application because of public testimony <br /> received at the Hearing. She summarized the reasons staff had <br /> recommended approval . <br /> In response to Council questions, Ms. Livermore said this is a <br /> Conditional Use, not a Variance. The lot is considered substandard <br /> because RM 1800 requires 100 feet in width, and the lot is only 75 feet <br /> wide, so anything other than a single-family home requires special <br /> approval . <br /> Council Members Myers and Gal van and Vice Mayor Kerr described contacts <br /> they have had regarding this project. All said it would not impact <br /> their ability to make a determination in this matter. <br /> In response to Council questions, Steve Emslie, Planning Manager, <br /> described the scope of a Conditional Use permit in setting Conditions. <br /> He said the issue is whether this proposal will support the General <br /> Plan, be consistent with the Zoning Code, and not be deleterious to the <br /> surrounding neighborhood. <br /> Staff presented slides of typical designs by this architect, projects <br /> in the surrounding area, examples of what the project would not be, and <br /> other two-story elements on Neptune Drive. <br /> The Hearing was then opened to the public. <br />
