Minutes - San Leandro City Council Meeting - September 5, 1995 Page - 6 - <br /> NEW BUSINESS (continued) <br /> Council Member Galvan said much of the program was an affirmation of <br /> things San Leandro is already doing. He said a lot is going on in <br /> cities all over California with redevelopment. He described Long <br /> Beach's success in creating a unique atmosphere in the Pine Street area <br /> through mixed uses and experiences and stressed that improvements must <br /> be considered on a property-by-property basis. <br /> C. Approval of Work Session Items Requiring Action. None. <br /> D. Report on Closed Session Actions Taken. No Closed Session was held. <br /> 8. PUBLIC HEARINGS <br /> A. Matter of Zoning Code Text Amendment (A-95-5) to Add "Group <br /> Residential " As a Use, Subject to Administrative Review, in the P <br /> Professional District; City of San Leandro, Applicant (allows "Group <br /> Residential " in the P Professional District subject to approval of a <br /> Group Residential Home permit by the Zoning Enforcement Official ) . <br /> This being the time and place for the Public Hearing on the above <br /> matter, Justin Murphy, Assistant Planner, gave the staff report. He <br /> said the Planning Commission recommended approval , with guidelines for <br /> the Zoning Enforcement Official to follow in permitting Group <br /> Residential uses in the P District. <br /> In response to Council questions, Mr. Murphy said there was no <br /> opposition expressed at the Planning Commission meeting or to staff. <br /> Steve Emslie, Planning Manager, said this text amendment applies to the <br /> entire P District, not just to one area. Staff explained that, under <br /> the current Zoning Code, applications for Group Residential in the P <br /> District cannot be made because they are not permitted uses. This <br /> modification to the Code would permit application for the use, subject <br /> to the determination and conditions of the Zoning Enforcement Officer. <br /> The Hearing was then opened to the public. <br /> Lou Filipovich, 15376 Laverne Drive, asked if the amendment would <br /> affect the entire City and if an approval could be appealed. Staff <br /> explained the amendment would affect the P Districts of the City only, <br /> and an approval could be appealed. Mr. Filipovich said his homeowners' <br /> insurance is being linked to zoning and three of the largest <br /> underwriters in the country will no longer sell certain kinds of <br /> liability insurance. <br /> Ellen Geis said homeowners' associations cannot change anything if it <br /> is zoned for something. She said information on this is not provided. <br /> She asked if Group Residential permitted alcoholics and prisoners. <br /> Staff explained regulation of Group Residential homes is pre-empted by <br /> State law. <br />
