Matter of Cable TV Performance Review and Proposed Rate Regulations. <br /> - Cable TV Annual Performance Review and Public Comments (review TCI's <br /> performance from January 1, 1995 through August 31 , 1995) . No <br /> action is required on this matter. <br /> - Proposed Cable TV Rate Regulations. <br /> Council Member Perry noted that TCI is a member of the collaborative <br /> which is funding the group by which she is employed; therefore, she <br /> would not participate in the hearing. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Kathy Ornelas, Community Relations Representative, presented <br /> the staff report on the Annual Performance Review. She discussed <br /> former telephone problems and explained steps TCI has taken to resolve <br /> them, including upgrading equipment and hiring additional staff. She <br /> said performance is now at or above industry standards. She described <br /> random calls made to TCI by City staff to evaluate phone service and <br /> said it was acceptable. Council Member Polvorosa noted he has been put <br /> on hold for as long as five minutes. <br /> Stephanie Lee, Information Services Manager, discussed the basic rates. <br /> She said a consultant was hired to analyze the rates in accordance with <br /> FCC requirements and has suggested modifications to the rates and <br /> refunds to customers. She described an amendment to the Resolution <br /> Disapproving the Rates Proposed by ICI Cablevision of Hayward for the <br /> Basic Service Tier in the Form 1200 and Form 1210, Ordering a Refund to <br /> Subscribers, and Making Findings in Connection Therewith. She also <br /> requested the City Council not take action on two other resolutions, <br /> based on a recent ruling from the FCC (Resolution Disapproving the <br /> Rates Proposed by TCI Cablevision of Hayward for the Basic Service Tier <br /> in the Form 1210, Dated March 29, 1995, Ordering a Refund to <br /> Subscribers, and Making Findings in Connection Therewith and Resolution <br /> Disapproving the Rates Proposed by TCI Cablevision of Hayward for the <br /> Basic Service Tier in the Form 1205, Dated February 28, 1995, Ordering <br /> a Refund to Subscribers, and Making Findings in Connection Therewith) . <br /> She said TCI plans to appeal any action by the Council to the FCC, so <br /> any decision made by Council will be stayed until acted upon by the <br /> FCC. <br /> Lee Perron, Manager, ICI Cablevision, said the FCC requirements are <br /> confusing and are frequently changed. He said TCI will appeal to the <br /> FCC and will abide by their order and, if required to make refunds, <br /> will work with the City to expedite them. He discussed steps TCI is <br /> taking to improve its service, including providing 95% of installations <br /> in less than seven days, service calls in less than 24 hours, and two- <br /> hour windows for service or a $20-credit or free installation for late <br /> responses. <br />
