Minutes - San Leandro City Council Meeting - January 11, 1993 Page - 15 - <br /> NEW BUSINESS (continued) <br /> Council Member Corbett said she is bothered that the Oakland City <br /> Council has no concern about the impact on San Leandro from this <br /> project. She said that has put San Leandro in a position of having to <br /> ask for mitigations elsewhere. She said she hoped Mrs. Van Puttkamer <br /> would advocate San Leandro' s position to Oakland. <br /> Jeff Houston, 1465 Burkhart Avenue, said there was a sign-up sheet for <br /> volunteers to recall Mayor Karp. He asked Steve Meyers why the MOU <br /> could not define the number of units. He said the Roberts Landing <br /> project could not bind future Councils with respect to airport <br /> expansion because the effects were unknown. He asked why the City did <br /> not indemnify the Port but can indemnify Mr. Smith. <br /> Steve Meyers said the Port was asking the City to agree that it would <br /> not oppose future expansion and would indemnify the Port over any noise <br /> or lawsuits . He said his advice at the time was that, since there were <br /> no current plans, the City Council could not be bound. He said he took <br /> exception to Mr. Houston' s comparison of the two projects . He said the <br /> covenant for this project binds the City Council not to sue unless the <br /> project is materially changed. .He said if the project is materially <br /> changed, then the MOU does not bind the Council . He said he cannot <br /> define a revised project, but CEQA requires that Oakland carefully <br /> review any change in the project to determine if there are any new <br /> environmental impacts which would require a supplemental EIR. This <br /> would constitute a material change, and the covenant not to sue would <br /> not apply. <br /> John Glaub, 1050 Lee Avenue, Board Member of Estudillo Homeowners <br /> Association, said people only found out about this meeting last Friday, <br /> yet there was a large turnout. He said everyone in San Leandro is <br /> outraged. He said community groups in San Leandro have opposed this <br /> for six years and have made a variety of presentations before the City <br /> Council . He said they were also told by staff members, including Mike <br /> Oliver, that there would be public participation in determining <br /> financial impacts on San Leandro. He said the cost estimates are <br /> inadequate. The costs are annual costs, not one-time initial ; numerous <br /> cost impacts have been deleted, including impacts on parks and <br /> recreation facilities; overcrowded stores and parking lots; police; <br /> fire; crossing-guard costs; and quality-of-life costs. Widening <br /> Bancroft and Dutton will not mitigate the problems. <br /> Mr. Oliver asked if Mr. Glaub was intimating that Mr. Oliver had <br /> suggested the widening of Bancroft and Dutton. <br /> Mr. Glaub said the impacts would be taken up by the general street- <br /> widening program. <br /> Mr. Oliver said this was untrue and was a misrepresentation of <br /> everything the City has put together for the Plan Line. <br />
