Minutes - San Leandro City Council Meeting - February 1, 1993 Page - 11 - <br /> PUBLIC HEARINGS (continued) <br /> homeowners association on an individual basis to review the Maps and <br /> then will take the community input information to the Planning <br /> Commission. <br /> Mr. Weisbrod noted that, when the Planning Commission considered A-92- <br /> 02, they also passed a Resolution of Intention to consider re-zoning A- <br /> 92-07 from I-P to I-2, at the request of the property owner. He said <br /> the property has 20 warehouse-type bays. He said the Planning <br /> Commission denied the re-zone request, and A-92-07 was also appealed to <br /> the City Council . He said the concerns with that property are similar <br /> to those for A-92-02. <br /> Council Member Kerr asked, related to the Federighi property, what the <br /> big difference would be between the I-2 and the I-P zoning on what the <br /> bays could be used for. Mr. Weisbrod said there had been a moving <br /> company that was required to relocate. He said, under I-2, the uses <br /> could be those that generate heavier truck traffic than under I-P. Mr. <br /> Weisbrod noted that the Federighi property has a requirement to provide <br /> a turning radius at the rear of the building so that trucks may go <br /> around the building instead of backing out and also to allow fire truck <br /> access. <br /> Council Member Kerr asked if the City could legally prevent someone <br /> from backing out of their own driveway onto the street. Mr. Weisbrod <br /> said, under discretionary review, the City could make such a <br /> requirement. He said backing out onto the street is only permitted in <br /> single-family homes and duplexes. He said all other zones require that <br /> vehicles be able to turn around on the site. <br /> Mayor Karp then requested that Mr. Kerry speak, followed by Mr. <br /> Federighi . <br /> William H. Kerry, spoke regarding A-92-02. He said, when he attempted <br /> to start action to re-zone properties in the area zoned I-P, everyone <br /> who was zoned I-P sent in letters in strong support of the re-zone. He <br /> said one of the reasons for his attending the Council meeting is that <br /> he operates the property on Neptune Drive and is conversant with the <br /> demands of BCDC. He said previous to his Application, Mr. Texeira, who <br /> has the Symons Corporation, had his property re-zoned to I-2. He said <br /> Mr. Texeira has done a good job and so has Mr. Kerry. He said the <br /> trucking operation is an exemplary operation; however, he said there is <br /> a continuous problem. He said the trucking operation has a legal , non- <br /> conforming-use Permit. He said Best's only client is Coca-Cola <br /> Company; and, at the time the Permit was obtained, they felt they could <br /> live within its limits. Since then, Coca-Cola has obtained a new <br /> client in China, and Best has no choice but to make deliveries when <br /> Coke wants them to. Mr. Kerry says he feels he has been subjected to <br /> harassment. He said Ruan Company left and moved to Tracy because of <br /> the problems. He said he is here because his Permit says trucks can <br /> only be run during certain hours. He said the homeowners association <br />
