Minutes - San Leandro City Council Meeting - February 1, 1993 Page - 12 - <br /> PUBLIC HEARINGS (continued) <br /> President has stated that Williams is a residential street. Mr. Kerry <br /> said it is not; it is a truck route. He said he wants to have a nice <br /> place and wants to make the most of the site. He said the yard is <br /> generally wide open. He said he talked to BCDC about their <br /> requirements, and those requirements are extensive. He said, if a new <br /> building is added, BCDC rules would be invoked. He said, as it stands, <br /> they are using the property as a legal , non-conforming use, and they <br /> want it re-zoned to I-2 so they can go about their business. <br /> Council Member Corbett asked if Best would be increasing the amount of <br /> truck traffic in the future if the zoning is changed. Mr. Kerry said <br /> he went through this process to get this Permit. He said, if they <br /> could live with the Conditions, they wouldn't be trying to get the <br /> property re-zoned. He said he is trying to keep industry in the City <br /> and doesn't know of any plans for expansion of the operation. <br /> Doug Federighi , spoke regarding A-92-07. He said he owns the property <br /> at the north side of Williams Street, between Aurora and Neptune Drive. <br /> He said he has no problem with the City delaying the re-zone until the <br /> new Zoning Code comes into effect. He said his property is already <br /> completely developed according to the I-P zone, and he has no plans to <br /> change its present use. He said they do seek relief by re-zoning <br /> related to the use. He presented Conditional Use Conditions for the <br /> property to the City Council and described those that create an unfair <br /> burden. He said his is one of the few properties in San Leandro that <br /> must allow turning for inter-state trucks, not semi 's. He said the <br /> impact of this Condition was to eliminate the potential for small units <br /> and create larger units, which are more difficult to rent. He said he <br /> is required to provide for large trucks., but he is subject to <br /> Conditions that greatly limit the use of large trucks. He said the <br /> item related to parking is unreasonable because it is very difficult to <br /> enforce where people park. He said the City has a right to dictate <br /> what goes on on public streets. He said he felt Items e and f were <br /> nuisance items. He said Item g precludes a range of tenants, such as <br /> auto-related uses for windshield replacement, installation of car <br /> alarms, etc. , that could be done within the building. He said these <br /> restrictions caused a tenant who occupied 30% of the site to leave. <br /> Council Member Kerr asked if this was the moving company. Mr. <br /> Federighi said it was a moving company. The company had contracted <br /> with the military to store furniture from service men for short periods <br /> of time. There was a considerable amount of truck traffic and large <br /> trucks. He said, if several large trucks arrived at the same time, <br /> there was no way they could meet the Conditions. <br />
