Minutes - San Leandro City Council Meeting - April 5, 1993 Page - 11 - PUBLIC HEARINGS (continued) Council Member Perry spoke regarding Condition IV.A and asked what would happen if the tenancy changes. Steve Meyers, City Attorney, said, as the Condition is currently written, it requires the Applicant to come back before the City Council . He said Conditional Uses run with the land so they can be transferred. He said, as long as the City is clear on the Conditions of the Planned Unit Development what the use is, the Applicant would have to come back before the Council . Council Member Perry said she would be more comfortable if it were clarified. Council Member Perry asked what Condition IV.D means and asked about concerns about cars after 10:00 at night. Mr. Penaranda said Condition IV.D. was the same as that which had been placed on Alta Mira. Steve Meyers said an objective measurement of noise is to use specialized equipment, otherwise it is subjective. He said he did not believe the City had the necessary equipment to measure noise. Council Member Perry said Conditions C and D seemed to be in conflict. Steve Emslie, Planning Manager, said the City does have a device to record noise. Council Member Perry suggested elimination of Condition IV.D. She also asked where the matter of cars after 10:00 p.m. was addressed. Council Member Faria asked, since this is not a Conditional Use, did the approval run with the property. Steve Meyers said, if the uses are very specific, they would have to come back to the City Council . He said if DCARA sells to some other organization that uses the site for a training facility for the deaf and hearing impaired it would not have to come back. He said it would if it were sold for some other use. Council Member Kerr asked if the project had to meet all of the requirements related to public assembly, such as handicap access, etc. Mr. Penaranda said it did. Council Member Kerr asked if this area were zoned 7-2. Mr. Penaranda said it is. Mr. Emslie said the zoning will be changed under the new Zoning Code because there is not a T-2 zone. Council Member Corbett asked if it was necessary to state the matter will have to come back before the Council for review. Mr. Meyers said the language in Condition IV.A could be modified to say that changes in the use would have to be approved by the City Council . Council Member Corbett asked for an explanation of _the parking. Mr. Penaranda said the parking requirement was one space per 200 square feet for the book store and 2/3 of 50 for the training facility. He said there would be 38 parking spaces.
