Steve Meyers, City Attorney, <br /> said, as the Condition is currently written, it requires the Applicant <br /> to come back before the City Council . He said Conditional Uses run <br /> with the land so they can be transferred. He said, as long as the City <br /> is clear on the Conditions of the Planned Unit Development what the use <br /> is, the Applicant would have to come back before the Council . <br /> Council Member Perry said she would be more comfortable if it were <br /> clarified. <br /> Council Member Perry asked what Condition IV.D means and asked about <br /> concerns about cars after 10:00 at night. Mr. Penaranda said Condition <br /> IV.D. was the same as that which had been placed on Alta Mira. <br /> Steve Meyers said an objective measurement of noise is to use <br /> specialized equipment, otherwise it is subjective. He said he did not <br /> believe the City had the necessary equipment to measure noise. <br /> Council Member Perry said Conditions C and D seemed to be in conflict. <br /> Steve Emslie, Planning Manager, said the City does have a device to <br /> record noise. <br /> Council Member Perry suggested elimination of Condition IV.D. She also <br /> asked where the matter of cars after 10:00 p.m. was addressed. <br /> Council Member Faria asked, since this is not a Conditional Use, did <br /> the approval run with the property. Steve Meyers said, if the uses are <br /> very specific, they would have to come back to the City Council . He <br /> said if DCARA sells to some other organization that uses the site for <br /> a training facility for the deaf and hearing impaired it would not have <br /> to come back. He said it would if it were sold for some other use. <br /> Council Member Kerr asked if the project had to meet all of the <br /> requirements related to public assembly, such as handicap access, etc. <br /> Mr. Penaranda said it did. <br /> Council Member Kerr asked if this area were zoned 7-2. Mr. Penaranda <br /> said it is. Mr. Emslie said the zoning will be changed under the new <br /> Zoning Code because there is not a T-2 zone. <br /> Council Member Corbett asked if it was necessary to state the matter <br /> will have to come back before the Council for review. Mr. Meyers said <br /> the language in Condition IV.A could be modified to say that changes in <br /> the use would have to be approved by the City Council . <br /> Council Member Corbett asked for an explanation of _the parking. Mr. <br /> Penaranda said the parking requirement was one space per 200 square <br /> feet for the book store and 2/3 of 50 for the training facility. He <br /> said there would be 38 parking spaces. <br />
