Minutes - San Leandro City Council Meeting - April 19, 1993 Page - 24 -
PUBLIC HEARINGS (continued)
Juan Ancheta, 110 Breed Avenue, said he did not have any objection and
wanted the work to be done. He said, however, in 1969, along the
Durant side of his property, one-half of the area had curb and the
other half was wood. He said, when the drain was installed, it damaged
the area that had curb. Mayor Karp asked if Mr. Ancheta had talked to
staff; Mr. Ancheta said he had. Bill Silva said this issue was
discussed with Mr. Ancheta this evening for the first time. Mr. Silva
said a storm-drain line was built in Durant Avenue and, according to
Mr. Ancheta, there was part concrete/part wood curb. He said the City
had no record of this. He said the improvement plans showed that the
drainage line was constructed when that area was still in the City of
Oakland; and, since then, there's been a boundary-line adjustment. He
requested that the Council confirm the Report of the Superintendent of
Streets, as presented, and staff would contact the Flood Control
District and see if they will take responsibility for this matter.
Steve Meyers noted, for the record, that there were no written or oral
protests to the Report of the Superintendent of Streets.
The following Resolution was then introduced:
Resolution No. 93-76, Resolution Confirming Special Assessments, Cost
of Sidewalk, Curb and Gutter Construction, Durant Avenue and Foothill
Boulevard Neighborhood Improvement District, Improvement Act of 1911
(confirms the Report of the Superintendent of Streets and assesses the
cost of repairs) . (2715)
Introduced by Council Member Corbett, who moved its adoption, seconded
by Council Member Myers, and carried by the following called vote:
AYES: Council Members Corbett, Faria, Kerr, Myers, Perry, Polvorosa;
Mayor Karp ( 7 )
NOES: None ( 0 )
ABSENT: None ( 0 )
C. Matter of Storm Water Enterprise Fund Service Fees for Fiscal Year
1993-94 (effective July 1, 1993) .
This being the time and place for the Public Hearing on the above
matter, Bob Taylor, Public Works Services Director, said the City
Council had adopted an ordinance establishing the Storm Water Utility.
He said the next phase was to establish the fee for implementation,
beginning in July 1993. He said staff prepared a budget they felt was
adequate to cover the cost of complying with the Alameda County Urban
Runoff Clean Water Program. He said determination of the budget figure
