Minutes - San Leandro City Council Meeting - April 19, 1993 Page - 26 - <br /> PUBLIC HEARINGS (continued) <br /> Council Member Faria asked what would happen if there was a freeway <br /> spill that goes into San Leandro's storm drains. Mr. Taylor said the <br /> State has jurisdiction and would do the remediation for it all the way <br /> through the system. He said Cal -Trans is a very responsible agency <br /> when it comes to spills on their facilities. <br /> Council Member Faria said it is common to see people draining their <br /> radiators over a storm drain and said he assumed public information <br /> would advise people they could not do that. Mr. Taylor said public <br /> information, on both the County and City level , is an important <br /> component of the program. <br /> Council Member Faria asked if the largest parcel in San Leandro is <br /> Bayfair. Mr. Taylor said it is one of the largest. Council Member <br /> Faria asked if there is a cap to the charge. Mr. Taylor said it is on <br /> a per acre basis. He said, if each of the Bayfair tenants had to get <br /> their own permit, it could well exceed the per-acre amount charged to <br /> Bayfair. <br /> Council Member Perry noted that the City would incur a $10,000-per-day <br /> fine if it does not comply with the program. She said it is a Federal <br /> and State mandate. She said it is not something she enjoys doing but <br /> is something the City has to do. She said all of the cities in Alameda <br /> County looked at the problem early on, which helped spread the costs to <br /> make it the lowest for the citizenry. She said, given the figures on <br /> the other cities, she understands it is also based 50% population/50% <br /> area, so it looks like San Leandro is getting more services for its <br /> dollars than some of the other cities that have higher populations. <br /> Mr. Taylor said it is difficult to make real comparisons, because you <br /> must take into account the demographics and the geography of the <br /> various cities. He said the 50% by area and 50% by population is for <br /> what' s called the General Program, and San Leandro's portion of the <br /> General Program is estimated to be about $135,000 next year. He said <br /> each city has its own municipal activities which they must do and <br /> different cities are doing it differently. He said San Leandro has <br /> been doing a lot of these things that are eligible for Gas Tax but has <br /> been funding them through the General Fund, primarily street sweeping. <br /> He said under Prop. 111 Gas Tax, there is an item called Maintenance of <br /> Effort; so if street sweeping is done with Gas Tax, then the same <br /> amount of money must be spent somewhere else, and the City does not <br /> have the money to spend. He said that is the reason the total street <br /> sweeping is included, because it is mandated and is not something which <br /> can be cut or funded in another way. <br /> Council Member Perry asked if this would come back for review every <br /> year. Mr. Taylor said it would. He said there would be one other <br /> contact with the City Council after the rate was established, when the <br /> number would be given to the Flood Control District, and then staff <br /> would have a final hearing to put the rate on every parcel within the <br /> City and put it on the tax roll . <br />
