.. Minutes,.- San Leandro City. Council Meeting - May 17, 1993 Page - 18 - <br /> PUBLIC HEARINGS (continued) <br /> Mayor Karp said the Negative Declaration was before the City Council <br /> again. Mr. Cook distributed photographs of the area. He said debris <br /> comes down onto Montrose Drive. He said the area is very steep, and <br /> they'll have to take out a lot of dirt and put in a 15- to 20-foot <br /> wall . He said that is a large impact on the area. He said, even if it <br /> is zoned R-I, he did not believe Mr. Lu could build anywhere he wanted <br /> to on the site. He said he believed the Planning Commission and the <br /> CC&R's would have something to say about that. <br /> Steve Meyers said Mr. Lu would be able to build anywhere on the site, <br /> subject to the Building Code, under the R-1 zoning provisions. <br /> Council Member Corbett asked if Mr. Cook disputed what had been stated <br /> by the developer about how much they were going to have to cut. Mr. <br /> Cook said he did; he said they would have to remove a lot of earth. He <br /> said the driveway would be in direct line with one of the other <br /> resident's pool . He asked who would be responsible if he had a problem <br /> with his house. <br /> Mayor Karp noted the engineers would have Errors and Omissions <br /> Insurance. <br /> Council Member Kerr asked if this development would make the dirt wash <br /> down any more than it already has. Mr. Cook said he felt it would and <br /> the driveways would cause erosion. <br /> Mayor Karp said he lives in Bay-O-Vista and has a drainage ditch to <br /> carry the water away from his property. <br /> Chester Griffin, 2027 Edgehill Court, said he agreed with Mr. Cook. He <br /> said he has a large fish pond that he has had problems with when it <br /> rains because the pond fills up and runs down the back yard. He said <br /> the soil is very loose. He said he had to install a small retaining <br /> wall to protect the back yard because of the fill . He said there are <br /> 20 to 30 large eucalyptus trees, and they will have to be removed to <br /> build the house, and the soil will be loosened even further. He said <br /> his cousin lived behind the San Leandro Hospital , and they saw what <br /> happened there. He said the soil was in that location a lot longer and <br /> was still very loose. He said the soil on this area is looser. He <br /> said there is a lot of wildlife; and, although they will come back, the <br /> issue here is to protect homes. He said he did not feel these two <br /> homes would be safe for the neighbors. <br /> Rosemary Edwards, 1473 Montrose Drive, said the City Council asked that <br /> the developer hold a neighbors meeting. She pointed out that, out of <br /> the 43 people who attended, only 5 received letters from the developer. <br /> She said she and her husband ran off and distributed flyers to all of <br /> the neighbors in the area. She said she was told 100 truck loads of <br /> dirt would be removed and that seemed like a lot to her. <br />
