Minutes - San Leandro City Council Meeting - June 21, 1993 Page - 19 - <br /> PUBLIC HEARINGS (continued) <br /> Council Member Perry asked if there was a public phone on the outside <br /> of any of the buildings, because that sometimes generates loitering, <br /> and whether they would object to a Condition prohibiting a phone. Mr. <br /> Mundy said there was no phone, and they would not object to such a <br /> Condition. <br /> In response to additional questions by Council Member Perry, Mr. Mundy <br /> said they would agree to a certain time period for deliveries, such as <br /> not before 6:00 a.m. or after some other time and not during peak <br /> hours. <br /> Mr. Mundy said he will be happy to discuss it but did not want to get <br /> locked into a two-hour time frame. He said the earliest they would <br /> make deliveries to the site would be 7:00 a.m. <br /> Council Member Perry asked, since there seemed to be neighborhood <br /> concerns, if the Applicant would agree to a six-month review period for <br /> compliance with the Conditions, such as litter and loitering. <br /> Richard Lowell , General Manager, Dolan Foster Enterprises, Inc. , said <br /> they are going to put over $200,000 into this site, and he said they <br /> prefer to stand on their record of how they run their other restaurants <br /> in San Leandro. He said their lease is for three years, and they <br /> prefer to say that the Planning Commission has the right to pull them <br /> back at any time they do not meet the Conditions. Mr. Penaranda <br /> pointed out that, if at any time the Conditions are violated, Dolan <br /> Foster would be asked to comply or their approval might be revoked. <br /> Council Member Corbett asked what Dolan Foster's standard was for turn- <br /> around time for graffiti removal . Mr. Lowell said they remove it as <br /> quickly as they can, depending upon what has been used, and it's <br /> usually done within a week or two. <br /> The Hearing was then opened to the public. <br /> Dan Vitello, 14982 Western Avenue, said he lives right around the <br /> corner from the site. He said he is concerned the area will be ruined <br /> by gangs hanging around at the site in the evenings. He said <br /> Copeland's Sports is a very nice building, and a Taco Bell would ruin <br /> it. He said the parking lot will look bad, and there will be increased <br /> crime. He said he and all of his neighbors who are elderly have had to <br /> call the police already on many occasions. He said their main concern <br /> is gangs hanging around. He said the company will not guarantee they <br /> will provide guards. He said the center was not built for foods; it <br /> was built for soft goods, and there will be noise from cars and litter. <br /> He said there would be problems with people making U-turns on Halcyon, <br /> and there is no signal there. He said the City of San Leandro should <br /> not allow a fast-food restaurant in such a nice development. <br />
