John Sullivan, Real Estate Broker, Shamrock Realtors, East 14th Street, <br /> San Lorenzo, said he supports the general concept of the redevelopment <br /> agency and commended the members for taking the initiative. He said, <br /> historically, a redevelopment area has ways of raising negatives and <br /> red flags. Many times those are unfounded. Under California real <br /> estate laws, property owners are mandated to disclose the fact that it <br /> is in a redevelopment district. Likewise, to avoid liability, to lease <br /> on a long term basis, one must disclose this information. This <br /> statement does turn buyers and prospective tenants away. Ultimately, <br /> real estate agents will steer into another area. A blighted area can <br /> be created, even though there is the opposite intent. He suggested <br /> that there be built in to this agency some language whereby a property <br /> owner, upon demand, could approach the agency and receive written <br /> documentation that would lay out exactly what will happen, how their <br /> property will be impacted, and also what the impact is for a one square <br /> block area, such as information about change of use, street changes, <br /> sidewalk improvements, or any other thing that would impact that <br /> property. There should be a real written disclosure available. He <br /> said it is important to take these steps. <br /> G. Joyce Rutledge, 474 Dolores Avenue, said she supports the redevelopment <br /> plan. She congratulated Paul Nahm and the Council for expediently <br /> filling the position. She said, in 1985 she worked in Engineering on <br /> right-of-way acquisition for Davis Street and is familiar with the <br /> legal and other issues of moving. The emotional trauma is the same for <br /> these new areas. People feel powerless and strong-armed into a move. <br /> The words "eminent domain" are intimidating. These cases will be <br /> absolutely last resort. To receive fair market value in today's market <br /> is almost the highest value amount. Many properties now are sold at <br /> less than that. Financially and emotionally, a compromising solution <br /> is the only win-win situation. Most Davis Street cases resulted in <br /> greater situations for the families. Redevelopment is absolutely vital <br /> for the area. It is expensive and it hurts, but can be looked at as a <br /> birth process. 20 years from now it will make us proud. Davis Street <br /> looks wonderful . The progressive attitude the City has taken has <br /> provided a healthy growing City of the times. <br /> H. Glenn Forbes, Attorney, Representing the Smooke Properties, commented <br /> that staff has been most helpful and cooperative in answering <br /> questions, and objections have been overcome. He said the plan will be <br /> beneficial for the City and unincorporated area. He said Ms. Catalano <br /> indicated that Section 501 of the plan provides that land use and land <br /> use standards for the properties shall be set forth in the General Plan <br /> for uses and standards. Where there is compliance, those uses shall be <br /> permitted under the plan. He said he had a concern with Section 517, <br /> which refers to incompatible uses, and he checked that out today with <br /> planning and legal staff and has no objections as submitted. <br />
