Minutes - San Leandro City Council Meeting - July 19, 1993 Page - 11 - <br /> ' PUBLIC HEARINGS (continued) <br /> costs had undergone a minor reduction associated with some EBMUD <br /> facilities; but, he said, other than that, there were no changes from <br /> the previous Engineer's Report. He said $298,000 of benefit to Chang <br /> from improvements constructed by Lincoln Property have been identified. <br /> He noted that Mr. Chang approached staff this evening and expressed <br /> concern and wished to comment during the Hearing. <br /> Steve Meyers, City Attorney, pointed out that, at the last City Council <br /> Meeting, the Council had asked for two changes to the Agreement; and he <br /> noted those changes have been made. <br /> The Hearing was then opened to the public. <br /> William Chang, President and CEO of Westlake Development Company, said <br /> he was informed by Mr. Oldrich that they had asked for a continuation <br /> to assess the engineering benefits. He said, on most of the items the <br /> split was 52% Lincoln Property/48% Chang. He said that is correct from <br /> an engineering viewpoint, but from an economic basis he believes it is <br /> grossly unfair. He said Martinez Street used to have access from Davis <br /> Street. He said the City agreed to improve Alvarado Street because <br /> Lincoln Property did not have access. Mr. Chang said he was told by <br /> the City that Martinez had to be closed off to accommodate a major <br /> intersection from Alvarado. He said his frontage on Martinez is double . <br /> that on Alvarado, but Martinez was closed off to accommodate Lincoln. <br /> He said he does have 48% of the frontage, but it is not fair <br /> economically. He said it would be okay if Martinez Street had not been <br /> closed, but his property was impacted by the closing of Martinez to <br /> accommodate Alvarado. He requested that the City Council consider the <br /> background of the property and said his property had lost value as a <br /> result of the closing of Martinez Street. <br /> Mayor Faria said Martinez Street is going to be abandoned as part of <br /> the Redevelopment Project. He said the Alvarado connection happened <br /> about four years ago, and this is the first time the City Council has <br /> heard from Mr. Chang. Mr. Chang said he met with Bill Rugg six years <br /> ago and was told that, if he objected publicly, he would be severely <br /> dealt with. <br /> Mayor Faria said he understands part of Martinez Street will become <br /> part of Mr. Chang's development when it is abandoned. He said it is <br /> important to keep lines of communication open. <br /> Mayor Faria asked how the Redevelopment Plan would affect Martinez <br /> Street and how it would affect Mr. Chang's property. <br /> June Catalano, Development Services Director, said nothing definitive <br /> has been determined yet, but this could be worked on with Engineering. <br /> In response to questions from the Council she said that Mr. Chang's <br /> concern was new to her; she had not been informed of this. She said <br /> that Mr. Chang has not discussed the Plan with her. <br />
