Minutes - San Leandro City Council Meeting - July 19, 1993 Page - 16 - <br /> PUBLIC HEARINGS (continued) <br /> He said Mr. Carash is trying to create the nucleus of an apartment <br /> house. Mr. Porter said the zoning laws have been bent and made null <br /> and void by the City Council and the Planning people. He said there <br /> are deed restrictions that still apply and said he bought his property <br /> with zoning laws because that's what they liked and the zoning laws are <br /> to protect people who have already bought. He said people spend their <br /> whole lives getting a nest egg to buy a house, and they rely on the <br /> zoning laws to protect them. He said it is the duty of the City to <br /> protect those rights. He said he understands making zoning changes in <br /> the business or industrial community because it changes, but people <br /> don't want their homes to change. He said they want to have police <br /> protection, lights on the streets, and the streets kept in order. He <br /> said there is a lack of truth in this whole thing. <br /> Mayor Faria said Mr. Porter would be given closing arguments. <br /> Council Member Kerr asked Mr. Porter if the foundation would be <br /> inadequate for a two-story building. Mr. Porter said there is no <br /> foundation on the south side. It is a concrete patio. He said the <br /> north side is built on the sea wall . <br /> Council Member Kerr asked if it existed in 1957 when it was annexed to <br /> the City. Mr. Porter said it existed, but it was a squatter's shack. <br /> He said he spent 6 months after the storm trying to pull the debris <br /> from this property out of his place. <br /> The Hearing was then opened to the public. <br /> Robert Storer, Pellegrini Construction, Representing the Owner of the <br /> Property, said Neptune Drive is unlike any other part of San Leandro. <br /> He said there is a beautiful skyline, golfing, and boating. He said <br /> there are 22 properties that back up to the bay. He said most people <br /> don't move from Neptune Drive and hand their houses down. He said 46% <br /> of the back yard is under water. He said, typically, the lots are 280 <br /> feet deep and 57 feet wide. He said the Carash's have been on their <br /> property since 1956 and would like to live in the rear house and have <br /> their family move into the front unit. He said, of the 22 properties <br /> in the area, 1 lot conforms, 1 almost conforms, 1 is undeveloped, and <br /> the remaining 19 are non-conforming with 0 to 3-1/2- to 4-1/2-foot <br /> setbacks. He said many have structures in the rear. He showed slides <br /> of properties representative of the Neptune Drive area and <br /> representative of the non-conforming setbacks. He said the property <br /> owner is not asking for anything unusual or trying to set a precedent. <br /> He said they would be setting a precedent if they did conform. He said <br /> they are not changing the character of the neighborhood. <br /> • <br />
