Minutes - San Leandro City Council Meeting - July 19, 1993 Page - 21 - <br /> PUBLIC HEARINGS (continued) <br /> In response to questions from the Council , he said he has had a crane <br /> in his yard for 5 years. He said he had to move 1,500 tons of broken <br /> concrete in order to fill in the area in the back after the storm. He <br /> said he has protected his neighbors' houses, worked on their cars, etc. <br /> He said he bought his lot in 1953 and built in 1957. He said Mr. <br /> Carash was renting. He said they are using the City to get what they <br /> want over and above his rights. Mr. Porter displayed photographs to <br /> the City Council of damage to his roof which has occurred from bamboo <br /> on Mr. Sellars' property. He said Mr. Sellars has refused to cut the <br /> bamboo. <br /> Mayor Faria requested that Mr. Porter address the matter at hand. <br /> Council Member Kerr asked, if the project was approved tonight, and it <br /> was all built according to the Building Code and brought up to <br /> standards, how would it be harmful to Mr. Porter's property. <br /> Mr. Porter said this will cut out the skyline view from his property <br /> because of the proximity to the side yard. He said, if he stayed 10 <br /> feet away, it would not be that great a problem. He said it would cut <br /> off part of the view of the bay and the skyline of Oyster Bay Park. <br /> Council Member Myers asked if Mr. Carash could build a one-story <br /> building on the existing footprint, within 3 feet. Mr. Weisbrod said <br /> he could rebuild the existing home prior to the storm damage and that <br /> would be 3 feet from the property line. He .said he needs a Variance <br /> because he is adding on, and the addition is going closer than 10 feet. <br /> He said the second story will be 6 feet instead of 10 feet on the south <br /> side. <br /> Mr. Porter said his whole family is incensed about these Variances. He <br /> said the contractor should have to prove the property is hooked up to <br /> the sewer. He said Mr. Carash told him it was not. Mr. Porter said <br /> there have been fumes, and there's been an auger put through the pipe. <br /> He said he does not think they are hooked up to the sewer. <br /> Mr. Porter said he felt there were devious people at City Hall , and he <br /> felt Mr. Weisbrod should be off the payroll . Mr. Porter said in 1955 <br /> or '56 he turned in petitions in Mulford Gardens to keep them out of <br /> San Leandro. <br /> There being no further comments from the public, on motion of Council <br /> Member Myers, seconded by Council Member Nahm, and carried unanimously, <br /> the Public Hearing was closed. <br /> Council Member Myers said there were some valid arguments by Mr. Porter <br /> and by the Mulford Gardens Improvement Association regarding zoning <br /> changes. He said there is growth and change and all cities have to <br /> have it. He said he thinks, in this particular case, this would be an <br /> improvement and will enhance Mr. Porter's property and property on <br /> Neptune Drive. <br />
