Minutes - San Leandro City Council Meeting - August 2, 1993 Page - 3 - <br /> PUBLIC COMMENTS (continued) <br /> F. Dave McDonald, Oakland Scavenger Company, spoke regarding New Business, <br /> Item B, and read the description, which said, "One effect of the <br /> proposed Ordinance would be to delete an existing exclusion from <br /> compliance with the Municipal Code provisions relating to garbage <br /> collection that applies to areas within the City limits but that are <br /> currently served by the Oro Loma Sanitary District. " He said Oakland <br /> Scavenger Company has served the Oro Loma Sanitary District since 1944 <br /> and has done business in San Leandro for a like number of years. He <br /> said, as to this Ordinance, he believes they are caught between a rock <br /> and a hard place. He said they work hard at maintaining good relations <br /> with the jurisdictions within which they work and the customers they <br /> serve. He said they have the franchise with the Oro Loma Sanitary <br /> District, and they believe action on this Ordinance infringes on their <br /> rights under that franchise. He said they are concerned about <br /> maintaining good relationships with everyone and concerned about their <br /> rights under their agreement with Oro Loma. He said they are concerned <br /> their customers would end up paying two franchise fees -- one to Oro <br /> Loma and one to San Leandro -- and was concerned that the Ordinance <br /> would become effective 30 days after adoption, which would not be <br /> enough time to work out a franchise agreement. In response to <br /> questions from the Council , he said the current contract with Oro Loma <br /> Sanitary District goes through the year 2003. <br /> Council Member Corbett said, when this item came up on the calendar, <br /> she would like to discuss some of these questions. <br /> Council Member Nahm asked if Mr. McDonald has provided to staff what <br /> rights they feel would be infringed upon by the Ordinance. Mr. <br /> McDonald said they had not yet had an opportunity to do so. He said <br /> they are concerned that they have a contract with Oro Loma Sanitary <br /> District under which they are required to pay a franchise fee through <br /> 2003; and, if this Ordinance passes, it would imply there would be <br /> another franchise fee that would be imposed upon their customers. <br /> G. Dana Johnson, 343 Farrelly Drive, said he has heard concerns at a <br /> number of homeowners' association meetings which he has attended <br /> regarding traffic and how hard it is to get a stop sign installed. He <br /> suggested the City Council should look at the criteria for stop signs. <br /> Mayor Faria said the City is required to follow the State of California <br /> criteria in order to install a stop sign. He said there are risk- <br /> management issues. He said he agreed it should be a quicker process <br /> and said the criteria could be provided to the associations. <br /> H. Susan Riskind-Poulsen, Broadmoor Boulevard, spoke regarding the same <br /> issue as Dana Johnson. She said she met with Mr. Smith, the Durant <br /> Manor Association in Oakland, who represents the Oakland side of Durant <br /> Avenue. He gave her a 1990 letter from the City of Oakland to his <br /> homeowners' association, regarding a request for a traffic signal at <br /> Durant and Bancroft. The letter said there had been a number of <br /> accidents there and that Oakland would be working with San Leandro on <br /> this. She said Mr. Smith still has not received a response. <br />
