Mr. <br /> Weisbrod said Graham Way would go to RD - two family. Council Member <br /> Perry noted some single-family sites have been converted to business <br /> uses, such as the hot tub sales office. She noted there are scattered <br /> duplexes on Wake; Mr. Weisbrod said these would become legal non- <br /> conforming. <br /> Council Member Perry said the strip park and BART area on Halcyon Drive <br /> should be zoned Open Space. Mr. Weisbrod said staff could make that <br /> correction. <br /> In response to questions, Mr. Weisbrod said duplexes that are destroyed <br /> could be rebuilt and explained the process. He said churches are only <br /> permitted in residential districts and are subject to Conditional Use <br /> approval . <br /> The Hearing was then opened to the public. <br /> A. Darren Molder, 653 Tudor Road, spoke regarding Beecher Street and <br /> said 10 years is too long to wait for changes or peace. He said <br /> after the current tenants move out the property has to be vacant <br /> for six months until new zoning kicks in. Mayor Faria said the <br /> property owner needs to be contacted because the City is concerned <br /> about the nighttime operation and the buffer zone for the <br /> residential neighborhood. He said the new Code at least provides <br /> some timetable. Council Member Myers said, if the property owner <br /> has been contacted, it is his responsibility to come in and express <br /> concern regarding downzoning. Steve Emslie said the property owner <br /> was sent a notice. Mayor Faria said they could take action <br /> tonight, but in the meantime, staff could work with the property <br /> owner. <br /> B. Bob Hartman, 1634 Russ Avenue, said his family owns 250-260 Elsie <br /> Avenue. There are commercial buildings adjacent to their property <br /> and across the street and income units behind them. His family <br /> requests permission to tear down their rental homes and put in four <br /> condos. There are condos behind them and adjacent to them. Mr. <br /> Weisbrod said all of those condominiums were developed as <br /> condominiums in the R-1 Single-Family Residential District; and, if <br /> City Council concurs, he can go through a Planned Development <br /> process in the RS Zone. <br /> C. Dr. Foster, 532 Joaquin Avenue, his office has been in operation <br /> for 35 years, and he would like to keep it there. In back of his <br /> office is a small rental house that he would like to keep as well . <br /> Mr. Weisbrod said the dental office is presently legal non- <br /> conforming and the single-family home is legal conforming. Zoning <br /> it to Professional would take care of the office; this would have <br /> to go back through the Planning Commission. Dr. Foster said he <br /> prefers to do this. <br />
