Scott Grubbs, 13475 Bancroft Avenue, #302, asked why the street lights <br /> on five blocks of East 14th Street were not lighted; it was noted there <br /> had been a power failure. <br /> E. Ed Alvarez, Vice President, Citation Homes, said Council Member <br /> Corbett, during the Work Session presentation on the Initiative, <br /> accused him of withholding information. He said the City Manager noted <br /> any action on the project would be suspended. He said he does not have <br /> any pending application before the Council . He said they recently <br /> approved the application for Phase 1 . He said it is his full intention <br /> to come back in with Phase 2 when all conditions are addressed, but he <br /> does not know what the City is suspending. He said the Department of <br /> Toxic Substance Control (DISC) letter purports that it has completed <br /> its review. He requested that the Council read his response to the <br /> DTSC letter and discuss it with staff and determine if they believe the <br /> City should take a more active role in what is happening at the DISC <br /> level . He said DISC changed the rules in 1993 and wants him to start <br /> all over again. He urged the City Council to read the DTSC letter and <br /> his response. <br /> F. Jeff Houston, 1465 Burkhart Avenue, said the DISC letter referred to a <br /> December 1st letter from DTSC that is a review of two reports Citation <br /> submitted, not a complete review. He said an analysis was conducted by <br /> two toxicologists at DISC. He read the summary page of the letter <br /> which said the authors of the report failed to follow PEA guidelines. <br /> He said his group has been saying the reports are not complete and now <br /> the State agency doctors agree. He said it is too late for the City to <br /> suspend action because they have already approved 250 homes, making the <br /> situation the same as Sandpiper. He requested that the City take steps <br /> to assure San Leandro would not be stuck with another Sandpiper <br /> situation. <br /> Mayor Faria said the City is on record as saying no building permits <br /> will be issued until all DTSC conditions have been met. <br /> Council Member Polvorosa said no homes will be built until the property <br /> is cleaned up. <br /> Mr. Houston said the City Council changed a law for Citation and could <br /> not be trusted. <br /> Council Member Perry said the City did not change any laws. She asked <br /> if one of the Conditions of Approval required cleanup and testing of <br /> soil contamination. The City Attorney said no permits will be issued <br /> until complete certification of the site is received. He said the City <br /> Council did modify the "S" zoning criteria to provide for timing of the <br /> PEA as part of the General Development Plan (GDP) rather than the <br /> Precise Development Plan (PDP) . <br />
