Rose Co. , 2399 Davis Street (Tony Yacek, Owner) . <br /> This being the time and place for the Public Hearing on the above <br /> matter, Elmer Penaranda, Assistant Planner, said the subject business <br /> specializes in receiving, temporarily storing, and transporting waste <br /> oil . He said the Application was approved by the Board of Zoning <br /> Adjustments and Appealed by Mr. Litke, a property owner next door. <br /> He described the existing site and proposed improvements and use of the <br /> site, including the containment area. He said Mr. Litke expressed <br /> concern regarding having a business which handles hazardous materials <br /> next door to him, and it may impact his property values. Mr. Penaranda <br /> said the Board of Zoning Adjustments found this is an appropriate, use <br /> with appropriate Conditions applied to it, and recommends approval . <br /> In response to City Council questions, Mr. Penaranda said the Fire <br /> Department hazardous materials staff had reviewed the project, as had <br /> the Water Pollution Control Plant staff. He said all their concerns <br /> were met through the containment area. He described the paving plan <br /> and access to the containment area and the uses of the properties on <br /> either side of the site. <br /> Council Member Polvorosa expressed concern that material would be <br /> dumped on the concrete and would seep through cracks. <br /> Council Member Nahm pointed out the Applicant does not intend to have <br /> anything dumped onto the ground and any spill will run off to the <br /> corner of the containment area. He said all precautions have been <br /> addressed and the capacity of the containment area is more than double <br /> the capacity of all the trucks on the site. <br />
