She said she was with <br /> her father at the time he spoke to Mr. Litke, he did not make the <br /> comment regarding Davis Street being the armpit of San Leandro, and it <br /> is not the type of thing her father would ever say. <br /> Mike Kuhl , 2374 Davis Street and three adjacent lots further west on <br /> Davis Street, said he thinks Ms. Falcon has done her homework. He said <br /> his family has owned property on Davis Street for many years, and he <br /> has seen a lot of changes, mostly for the good. He said the Falcons <br /> have jumped through every hoop thrown at them, they are an upstanding <br /> company, and are willing to accept responsibility. He said, if they <br /> make a mess, the City will require they clean it up. <br /> Lou Filipovich, 15376 Laverne Drive, said, when he had a business <br /> across from Hoehner's he had to have special insurance. He said this <br /> Appeal is a classic example of one of the problems with the Appeal <br /> process. He said the City is going to have to get zoning down to spot <br /> zoning. He spoke regarding steam cleaning, the Board of Zoning <br /> Adjustments' Minutes, and the transportation operation's using outside <br /> carriers. He said this is the wrong location for this business, and it <br /> is not a hazardous materials business, it is a trucking company. <br /> Council Member Myers said, although he understood Mr. Litke's point, <br /> the Conditional Use process places Conditions upon the use and said Mr. <br /> Litke could contact the City and the City would monitor any problems. <br /> There being no further comments from the public, on motion of Council <br /> Member Myers, seconded by Council Member Perry, and carried <br /> unanimously, the Public Hearing was closed. <br /> The following Motion was then introduced: <br /> Minute Order No. 94-6. Matter of CU-93-30; Appeal by Jack Litke of the <br /> Board of Zoning Adjustments' Approval of CU-93-30; Conditional Use; to <br /> Permit the Bulk Handling of Petroleum Products for Transportation to a <br /> Recycling and Refining Facility in Southern California; 2374 Davis <br /> Street; Assessor's Parcel Number 77A-649-8-18; Waste Oil Recovery <br /> Systems, Inc. ; I-2 (General Industrial ) District. (1098) <br /> Based on the Conditions and Findings, on motion by Council Member <br /> Myers, who moved its approval , seconded by Council Member Nahm, and <br /> carried by the following called vote, the City Council denied the <br /> Appeal of CU-93-30 and upheld the recommendation of the Board of Zoning <br /> Adjustments. <br /> AYES: Council Members Corbett, Kerr, Myers, Nahm, Perry, Polvorosa; <br /> Mayor Faria ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br />
