Resolution Approving Vesting Tentative Map, Tract 6494, 262-282 <br /> Estabrook Street. <br /> Elmer Penaranda, Assistant Planner, said the subject property was <br /> located on Estabrook Avenue west of Washington, between an existing <br /> condominium and an apartment complex. He said the map before the City <br /> Council was for a 14-unit condominium. He said it would be a 1-lot <br /> subdivision and the buyers of the units would own the air space. He <br /> said the map conforms with Site Development and Conditional Use <br /> approval . He said the proposal would consist of five buildings. He <br /> said the Planning Commission and staff recommended approval of the Map, <br /> subject to the Conditions of Approval . He noted that the Planning <br /> Commission had expressed concern regarding Condition No. 7 of the <br /> Engineer's Report related to the sanitary sewer and had not made a <br /> recommendation on that Condition. <br /> Bill Algire, Director of Engineering and Transportation, said when <br /> Condition No. 7 of the Engineer's Report was presented to the Planning <br /> Commission, it brought up questions related to policy. He said the <br /> site has a six-inch clay, gravity sewer-line that is quite old and flat <br /> and has limited capacity. He said the City Engineer was concerned <br /> about the capacity of the sewer and whether or not it would be able to <br /> handle the additional 14 units. He, therefore, included a condition <br /> that, due to the concerns related to the impact of the added flow from <br /> the proposed project, the City would conduct a capacity analysis to <br /> determine if additional capacity was necessary. If it was determined <br /> additional capacity was necessary, the developer would be responsible <br /> for paying a pro-rata share of the cost to up-size the sewer line. He <br /> said it was unknown at this time if the sewer would need to be up- <br /> sized; but, if it did, the total cost would be approximately $40,000. <br /> He said it was anticipated that the pro-rata cost for the developer <br /> would be approximately $1 , 100. He said Engineering felt there were two <br /> options: the City Council could approve the Tentative Map, with <br /> approval of Engineering's Condition No. 7, or they could delete <br /> Condition No. 7 entirely. He said it would take approximately two <br /> weeks to a month for the analysis of the sewer-line capacity to be <br /> completed. <br /> Mayor Karp said the developer of this project has been subject to many <br /> delays and has been trying to get it approved for the last two years. <br /> He said the first plan submitted was turned down. He said a second <br /> plan was submitted and it was also turned down, so the developer was <br /> back to the first plan. He said the developer had been told by staff <br /> to hire a consultant and had done so at considerable expense. He said <br /> he felt existing sewer-connection fees paid for any upgrading that <br /> needed to be done to the sewer. He said it was not up to staff to <br /> determine policy and this matter was a matter of policy, which should <br /> be brought before the City Council but should not be decided on this <br /> project alone. He said Engineering's Condition No. 7 should be <br /> deleted. <br />
