Minutes - San Leandro City Council Meeting - February 18, 1992 Page - 15 - <br /> 8. PUBLIC HEARINGS <br /> A. Matter of Appeal by William H. Kerry of the Revocation of the Zoning <br /> Approval , ZA-91-1, for Best Transport, Inc. , and Ruan Leasing Company <br /> for Expansion of a Legal , Non-Conforming Use, in Violation of the <br /> Zoning Code; 1791 Neptune Drive; Assessor's Parcel Number 79A-541-36; <br /> I-P Zoning District. Continued from the November 18, 1991, City <br /> Council Meeting. <br /> This being the time and place for continuing the Public Hearing on the <br /> above matter, Joann Scilley, Community Standards Coordinator, said, <br /> when this matter last came to City Council , Council had directed staff <br /> to look into alternative sites for the Best-Ruan use. <br /> She said a meeting had been held with Best; Bill Kerry, the property <br /> owner; and the Mulford Gardens Improvement Association. She said they <br /> discussed alternative access to the site. <br /> She said Williams Street is a local truck route with only 10 houses <br /> facing on it. She said any other route would have impact on a greater <br /> number of residences. She said staff also looked into the possibility <br /> of extending Polvorosa Avenue through to Neptune Drive and discussed <br /> the matter with East Bay Regional Parks, which had investigated an <br /> alternative route to Oyster Bay Park; but it was determined that the <br /> cost of the extension would be approximately $1 million and would <br /> require the taking of 51,000 square feet of industrial land, so it was <br /> found not to be feasible. <br /> She said staff also looked at the possibility of extending Neptune <br /> Drive through the Hohener property to Davis Street, but the Hohener <br /> site is designated wet land and has been removed from the Master Plan <br /> of City Streets. <br /> She said staff offered Best and Ruan assistance in relocating. Best <br /> indicated they have investigated other sites in San Leandro, but the <br /> costs are prohibitive. Best asked for a compromise in the zoning <br /> approval to change the starting time to 5:00 a.m. , which would <br /> eliminate most of the violations. This proposal was rejected by the <br /> Mulford Gardens Improvement Association. <br /> Ms. Scilley said staff was unable to resolve the issues, and there is <br /> no information to indicate that Best has been operating in accordance <br /> with the Conditions of the Zoning approval ; therefore, it is <br /> recommended that the zoning approval be revoked. She said, in <br /> recognition of the impact this will have on the employees and the <br /> business, it is recommended Best be provided with a nine-month <br /> extension to allow for a reasonable period of time to find alternative <br /> locations. <br /> Council Member Santos asked questions regarding the number of trucks <br /> leaving the site in off hours. Ms. Scilley said, in a one-month <br /> period, there were 100-150 vehicles which violated the Conditions of <br /> Approval . She said the requested modification to the Conditions would <br />
