She said the violations <br /> are strictly Best Company because Best must meet the requirements of <br /> Coca-Cola. <br /> In response to questions from City Council , Ms. Scilley said Mulford <br /> Gardens had rejected Best's alternative proposal because there would <br /> still be violations of the Conditions of Approval which would create <br /> truck noise. <br /> Council Member Santos said he did not feel the truck noise could be <br /> worse than the noise created by airplanes taking off and landing at the <br /> Oakland Airport and asked if staff had tested for noise levels. Ms. <br /> Scilley said the basis of the action is not related to noise, but that <br /> Best has expanded their allowable level of activity in a non-conforming <br /> use. She said there are no limits on noise, but there are limits on <br /> the number of truck trips and the hours of operation. <br /> Mayor Karp recommended that the City Council look at re-zoning this <br /> property back to I-2. Ms. Scilley said the use would then be legal . <br /> Steve Emslie, Planning Manager, said there are a number of areas to <br /> look at in assessing a potential re-zoning. He said the area currently <br /> zoned I-P encompasses a number of properties. He said the Texeira/East <br /> Bay Leasing property is I-P, there are some I-2 properties served by <br /> Polvorosa Avenue, as well as a couple of I-P office uses. He said <br /> Williams Street is basically under-utilized and there is excess <br /> capacity. <br /> In response to comments by the City Council , Steve Meyers, City <br /> Attorney, recommended the City Council not take action to revoke the <br /> zoning approval tonight but that they continue the Hearing, pending a <br /> zoning study, and direct staff to prepare a Resolution of Intention to <br /> Re-Zone from I-P to I-2. <br />
