Matter of Appeal by East Bay Leasing Corporation of Planning Commission <br /> Denial of A-89-02; Amendment; to Rezone a 6. 1-Acre Parcel from I-P <br /> (Industrial Park) to I-2 (General Industrial ) ; 2575 Williams Street; <br /> Assessor's Parcel Number 79A-541-019; East Bay Leasing Corporation; I-P <br /> (Industrial Park) District. Removed from °Table° at the February 18, <br /> 1992, City Council Meeting. <br /> This being the time and place for the Public Hearing on the above <br /> matter, June Catalano, Planning and Building Department Director, said <br /> staff was directed to prepare a report on the tabled Appeal of the <br /> zoning amendment denial . She said the Appeal had been denied by the <br /> Planning Commission and later Appealed by the Applicant to the City <br /> Council . The City Council conducted a Public Hearing at which the <br /> Applicant informed the City Council that plans for a Planned <br /> Development had been submitted to the City. Therefore, the Appeal on <br /> the matter of rezoning the property was tabled. <br /> She said subsequently the Planned Development was adopted but the <br /> rezoning was not reconsidered. She said staff is not recommending that <br /> the zoning be amended but is recommending that it remain I-P. <br /> She said the City Council had alternatives related to the property. <br /> She said they could rezone the property from I-P back to I-2. She said <br /> another alternative was the preparation of a Specific Plan for the <br /> area. She said staff believed such a plan could be completed in-house <br /> by the end of May. She said, in essence, a Specific Plan replaces the <br /> zoning for the area. <br /> Council Member Faria asked questions regarding the recommendation for <br /> a Specific Plan. He said this matter has been an issue for several <br /> years, and the property owner has lost a number of prospective tenants <br /> because he cannot find appropriate uses. He asked how the new Zoning <br /> Code would affect existing property that is zoned I-2 or I-P. He noted <br /> there is a parcel adjacent to the subject property that is still zoned <br /> I-2. He said he feels I-2 is the best zone for this property and is <br /> concerned the new Zoning Code may impact the property. <br /> Steve Meyers, City Attorney, said that, to the extent the new Zoning <br /> Code contains different provisions for I-2 from the old Code, those new <br /> provisions would apply. He said, if the property had a tenant under <br /> the current I-2 zoning at the time the Zoning Code was amended, that <br /> tenant would become a legal , non-conforming use for those areas that <br /> changed under the new Zoning Code. <br /> Council Member Faria said he understands the new Zoning Code will <br /> provide for a staff-review process for all I-2 zones. Staff indicated <br /> this was correct. <br /> Council Member Corbett asked, if this property is rezoned prior to <br /> adoption of the new Zoning Code, would it be a pre-existing use.
