• <br /> Minutes - San Leandro City Council Meeting - April 6, 1992 Page - 22 - <br /> PUBLIC HEARINGS (continued) <br /> ) <br /> Council Member Glaze asked if the City Council would be required to <br /> impose a mitigation program if the School District did not develop a <br /> plan with Citation. <br /> Steve Meyers, City Attorney, said, yes, the Conditions required that if <br /> no resolution of this issue is accomplished between the School District <br /> and the City, the City Council cannot approve the project, or, it can <br /> approve the project and determine the level of mitigation in excess of <br /> statutory fees. <br /> Council Member Polvorosa asked if all of the students would attend San <br /> Leandro Unified School District. Mr. Tubbs said San Lorenzo Unified <br /> School District had indicated it did not want to take students from the <br /> development. <br /> Council Member Perry asked questions regarding the need to provide <br /> auxiliary staff, such as crossing guards, and at playgrounds. Mr. <br /> Tubbs said they already had crossing guards but they knew that buses <br /> would be needed to transport students. <br /> Martin Vitz, East Bay Regional Park District, Advance Planning Manager, <br /> noted the District's April 3 letter. He said the District recognizes <br /> the regional value of the site as open space and the shoreline trail <br /> and the national significance of the site as a wetland area. He said <br /> they are willing to take on management of the site and referred to his <br /> letter. He said they did require that there be a fully integrated <br /> management plan, a formal management agreement, a means of funding the <br /> operations of the site, and the assurance that the discovery of toxics <br /> would not undo any of the above. <br /> Council Member Santos said many people felt the District should have <br /> taken more of a leadership role in development of the site. He said it <br /> sounds like the Park District wants to come away with a program for <br /> which it has no financial liability and no cost to the District. He <br /> said funding sources are to come from other agencies. Mr. Vitz said <br /> they realized they cannot avoid all costs but they want to find a way <br /> to fund the Park, the basic management costs, such as through an <br /> assessment district. <br /> Council Member Faria asked if the District wanted to be able to form <br /> its own assessment district. Mr. Vitz said, although they are legally <br /> empowered to do so, they would prefer to participate in a City-formed <br /> assessment district. Council Member Faria asked what assurance there <br /> was that the State Lands Commission would give East Bay Regional Park <br /> District the authority to operate the site. <br />
