Resolution of Intention to Initiate Re-Zoning Amendment for the West <br /> Side of Neptune Drive from I-P (Industrial Park) District to I-2 <br /> (General Industrial ) District (directs the Planning Commission to hold <br /> a Public Hearing to re-zone the property from I-P to I-2) . <br /> Council Member Kerr asked for additional history on this matter. <br /> June Catalano, Director of Planning and Building, said, at its March <br /> 16, 1992, meeting, the City Council directed the Planning Commission to <br /> prepare a Resolution of Intention to Re-Zone 1791 Neptune Drive from I- <br /> P to I-2. She said the Planning Commission decided not to initiate <br /> this code change, but the Municipal Code provides that either the <br /> Planning Commission or the City Council can do so. She said the City <br /> Council has now decided to initiate the zoning change. She said this <br /> does not re-zone the property, it simply initiates the legal process <br /> Council Member Myers asked if this action sends the matter back to the <br /> Planning Commission for formal Hearings and then back to the City <br /> Council for additional Public Hearings. Staff indicated this was <br /> correct. <br /> Larry Norry, President of Mulford Gardens Improvement Association, said <br /> this matter has gone before the Planning Commission a couple of times. <br /> He said he felt the two newly elected City Council members should <br /> receive a thorough briefing on this issue. He said Mr. Kerry purchased <br /> the property three years ago and leased it illegally to two trucking <br /> companies. He said the City sent him letters that it was illegal . He <br /> said in October they were granted a legal , non-conforming status. He <br /> said he would like to see one of the newly elected Council Members make <br /> a motion that this matter be kicked out. <br /> The following Resolution was then introduced: <br /> RESOLUTION NO. 92-120 (1099) <br /> RESOLUTION OF INTENTION TO INITIATE RE-ZONING AMENDMENT <br /> FOR THE WEST SIDE OF NEPTUNE DRIVE <br /> FROM I-P (INDUSTRIAL PARK) DISTRICT <br /> TO I-2 (GENERAL INDUSTRIAL) DISTRICT <br /> Introduced by Council Member Faria, who moved its adoption, seconded by Council <br /> Member Polvorosa, and carried by the following called vote: <br /> AYES: Council Members Faria, Perry, Polvorosa; Mayor Karp ( 4 ) <br /> NOES: Council Members Corbett and Myers ( 2 ) <br /> ABSENT: None ( 0 ) <br /> ABSTAIN: Council Member Kerr ( 1 ) <br />
