Minutes - San Leandro City Council Meeting - June 1, 1992 Page - 17 - <br /> PUBLIC HEARINGS (continued) <br /> B. Matter of Condemnation of Property Located at 1188 Montague Avenue <br /> (Wells Fargo Bank) for Measure B - Teagarden Street Extension Project. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Bill Silva, City Engineer, said the subject condemnation <br /> related to construction of the Teagarden Extension connecting Monterey <br /> with Aladdin. He said this was a Measure B Project. He said prior to <br /> construction the City must acquire 2,344 square feet along the new <br /> Teagarden Extension frontage of the property owned by Wells Fargo Bank. <br /> He said the issue tonight was to request City Council approval to allow <br /> the City Attorney to take appropriate action to acquire the property <br /> prior to construction through Eminent Domain. <br /> He said the City had a letter from Wells Fargo Bank, requesting that <br /> they be permitted to speak. He noted the County Right-of-Way Agent <br /> John Fenstermacher was in the audience and available to answer any <br /> questions. <br /> John Feinstermacher said part of the subject acquisition affects the <br /> California Service Tools building. He said he felt a solution had been <br /> reached with the tenants with which the tenants are pleased. He said <br /> previously the City was talking about actually taking the building, but <br /> now they have decided they could notch the road and take only a small <br /> portion of the building and keep the business in operation. <br /> The Hearing was then opened to the public. <br /> Joe Schrader, Wells Fargo Bank, said the property is owned by the Eva <br /> Trust, for which the Bank is the Trustee. He said they are in basic <br /> agreement with the project. He said they had a couple of clarification <br /> points, and they were requesting indemnification for the work that was <br /> to be done. He said there are two loading docks for the California <br /> Service Tool operation, and there are proposals which have been drafted <br /> to relocate the docks. He said the Bank has asked that, in the final <br /> agreement, the Bank receive indemnification. <br /> Mike Riback, Chief Assistant City Attorney, recommended the City <br /> Council move forward with the Resolution of Necessity and direct the <br /> City Council to communicate with legal counsel for the Eva Trust to <br /> resolve the issues set forth in their letter. He said this is the <br /> first time he has seen the letter and he was not prepared to comment. <br />
