He said because of timing requirements, these actions must be <br /> taken now in order to move the project forward. He said Reynolds and <br /> Brown and the City have committed to agree that the necessary first <br /> steps could be taken to lay the groundwork for this development if it <br /> is decided to proceed. He said Reynolds and Brown will bear the costs <br /> for the items on the agenda, including staff costs, outside contract <br /> services, environmental and engineering costs, and assessment district <br /> proceedings. He discussed each of the items listed on the City <br /> Council 's agenda. <br /> Predevelopment MOU - He said this is a three-party agreement among <br /> the City, the School District and Reynolds and Brown which acknowledges <br /> interest in proceeding with the development, and this would be used in <br /> the same manner as a "letter of intent" . <br /> Resolution of Intention to Amend the General Plan - He said this <br /> resolution initiates the Planning Commission review of the necessary <br /> modifications to the General Plan for the sports complex at the Peralta <br /> site and allows the clock to begin so that if the development is <br /> approved, it can be completed in time to conform to State law. <br /> Resolution of Intention to Rezone - He said this initiates the Planning <br /> Commission process for rezoning the property. <br /> City Engineer's Services Plan - He said this allows the City Engineer <br /> to begin to conceptualize the necessary infrastructure. <br /> City Engineer's Memorandum - He said this allows the initial steps to <br /> be taken on the Assessment District. <br /> Contractual Services Agreement with Environmental Sciences Associates - <br /> He said this will begin the necessary environmental process. <br /> He said any of these actions can be terminated by the City Council at <br /> any time. He said staff is meeting with the School District and with <br /> Reynolds and Brown on an on-going basis. <br /> Council Member Faria requested an explanation of the difference between <br /> an acquisition district and an assessment district. Steve Meyers, City <br /> Attorney, explained that in an acquisition district funds can be raised <br /> prior to construction of improvements, whereas an assessment district <br /> is usually created after completion of the improvements. <br /> Council Member Perry asked what would happen if the School District did <br /> not sign the Predevelopment Memorandum of Understanding (PMOU) . Mr. <br /> Meyers the project would not move forward. He said all three parties <br /> to the agreement must concur. <br /> Mr. Meyers said if the City Council directed staff to move forward on <br /> the project, the necessary analyses and discussions among all three <br /> parties would take place.
