Minutes - San Leandro City Council Meeting - July 20, 1992 Page - 10 - <br /> PUBLIC HEARINGS (continued) <br /> Steve Meyers said the arbitration provision is an attempt by the staff <br /> in negotiating this Agreement to provide for a means of resolving <br /> disputes over the interpretation of the Agreement. He said since this <br /> Agreement lasts for 20 years, it is important to be able to interpret <br /> the Agreement and resolve any differences of opinion about it in <br /> something less formal than a judicial proceeding or law suit. He said <br /> this is a very unique Agreement and the provisions are quite unique. <br /> He said the City has no comparable agreement, and may not have any <br /> other agreement of this nature in the future. <br /> Council Member Myers asked how design quality is judged or measured. <br /> Mr. Weisbrod said, under the current C-2 zoning, any expansion requires <br /> Conditional Use approval , but under Conditional Use approval , there is <br /> no design criteria. He said this manual will set forth design <br /> criteria. He said we could look at comparable shopping centers and <br /> come up with something that is acceptable. He said many new stores <br /> have their own image and we will make sure that it blends in with the <br /> existing architecture in the Center. <br /> Council Member Myers asked if a formal review of the security <br /> provisions could be required by the City Council every 12 months or so. <br /> Mike Oliver said the City has had an aggressive Crime Prevention <br /> Program for 25 years. He said part of that program has included a <br /> commercial component. He said the Police Department has worked <br /> routinely with the larger commercial centers. He said the most recent <br /> example has been Marina Square; he said the City's Crime Prevention <br /> people spent an extensive amount of time with them, assisting them in <br /> setting their operation up, and working with them to fine-tune those <br /> security procedures. He said since Bayfair opened in 1955, the Police <br /> Department has worked exceptionally well with them. He said it is <br /> important to recognize that we have been communicating with Bayfair <br /> management and staff. He said a number of staff toured the Solano Mall <br /> and discussed the issue of security with their City Manager-and Mayor. <br /> He said the City was able to identify -that virtually every item that <br /> • Solano had in place or were thinking of, •the -City of San Leandro has in <br /> place and has been working well for a significant amount of time. The <br /> only thing San Leandro doesn't have is City Hall in the Mall concept, <br /> but we are following up on that concept. <br /> Mr. Oliver said he feels very confident with the relationship that the <br /> City has with the Bayfair and Westfield people. He said asking for an <br /> update on security is certainly something that can be provided, but a <br /> formal requirement is probably, in his view, not something that will <br /> attain anything that isn't occurring on a daily basis. He said we now <br /> have bicycle patrols out on a regular basis . He said the activities <br /> that generated the concern at the Mall have been addressed. <br />
