She said the <br /> property owners had been notified and given the opportunity to pay. <br /> Council Member Polvorosa asked how many of the properties were repeats <br /> from last year. Ms. Scilley said all of them except 911 Dabner were <br /> repeats. <br /> The Hearing was then opened to the public. <br /> There being no comments from the public, on motion of Council Member <br /> Polvorosa, seconded by Council Member Kerr, and carried unanimously, <br /> the Public Hearing was closed. <br /> The following Resolution was then introduced: <br /> - Resolution No. 92-229, Resolution Confirming Report of the Planning <br /> and Building Department and Imposing Liens for Non-Payment of Weed <br /> Abatement Charges (authorizes the City to lien properties for non- <br /> payment of Weed Abatement charges) . (1197) <br /> Introduced by Council Member Kerr, who moved its adoption, seconded <br /> by Council Member Polvorosa, and carried by the following called <br /> vote: <br /> AYES: Council Members Corbett, Faria, Kerr, Myers, Perry, <br /> Polvorosa; Mayor Karp ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br /> C. Matter of A-92-01 ; Reclassification; City Council Consideration of a <br /> Request to Rezone from R-3 (Multiple Residential ) District to C-2 <br /> (Light Commercial ) District or to Such Zone that May Be Appropriate; <br /> 1401 Grand Avenue (Arco Station) ; Assessor's Parcel Number 77-600-1-2; <br /> Manmohan and Chander Chopra; R-3 (Multiple Residential ) District. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Elmer Penaranda, Assistant Planner, said the subject property <br /> contains an Arco Self-Serve Station and a convenience store and is <br /> currently zoned R-3. He said the use is legal , non-conforming and the <br /> self-serve and the store can continue to operate; but, he said, if the <br /> store is damaged, it could not be reconstructed if the cost exceeded <br /> 500 of the value of the building. He said the property owner is <br /> requesting re-zoning to allow the legal , non-conforming use to <br /> continue. He said approval will allow the property owner to apply for <br /> a Conditional Use Permit for 24-hour service as well as other <br /> modifications to the site. He said the proximity of the MacArthur <br /> Freeway makes construction of a residential development at this <br /> property extremely unlikely. He said the requested reclassification <br /> will be in conformance with the General Plan and the Zoning Code. <br />
