Minutes - San Leandro City Council Meeting - August 3, 1992 Page - 8 - <br /> PUBLIC HEARINGS (continued) <br /> The following Resolution was then introduced: <br /> - Resolution No. 92-226, Resolution Establishing Appropriation Limit, <br /> Fiscal Year 1992-93 (establishes the City's spending limit for the <br /> 1992-93 budget, as required by State law) . (2341) <br /> Introduced by Council Member Faria, who moved its adoption, seconded <br /> by Council Member Polvorosa, and carried by the following called <br /> vote: <br /> AYES: Council Members Corbett, Faria, Kerr, Myers, Perry, <br /> Polvorosa; Mayor Karp ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br /> Mayor Karp said in 1979, with Proposition 4, progressive City staff <br /> protected the City early on, and the City is still in a safe position. <br /> He said some cities were not so fortunate and have very severe growth <br /> limits. <br /> B. Matter of Imposing Liens for Non-Payment of Charges: <br /> 1. Report of the Finance Director - Imposing Liens for Non-Payment of <br /> Refuse and/or Sewer Service Charges and Business License Fees. <br /> This being the time and place for the Public Hearing on the above <br /> matter, John Jermanis, Finance Director, said each year he brings to <br /> the City Council delinquent sewer and refuse service charges and <br /> requests approval to place these charges as liens against properties. <br /> He said refuse service for residential accounts, except for special <br /> services, is automatically placed on property taxes. He said <br /> commercial services are not on the taxes. He presented a revised list <br /> showing property owners who had paid their bills as of the end of the <br /> day today. He said property owners have been advised a minimum of five <br /> times over the last eight months that these bills were outstanding, and <br /> they had been notified that liens will be placed against their <br /> properties. <br /> Council Member Corbett asked what kind of enforcement power the City <br /> has to collect outstanding debts from tenants who have left town. Mr. <br /> Jermanis said his staff checks delinquencies on a monthly basis; and, <br /> as soon as delinquencies begin to appear, the property owner is <br /> notified. He said it is ultimately the property owner's obligation to <br /> see that the bills are paid. <br /> Council Member Corbett asked if there was any kind of a cutoff of <br /> service when bills reached a certain level . <br />
