Minutes - San Leandro City Council Meeting - August 17, 1992 Page - 11 - <br /> NEW BUSINESS (continued) <br /> Jan Fong, 1623 Edgehill Court, said she and her husband spent <br /> substantial amounts of money to correct drainage problems on their <br /> property. She said there is a lot of wildlife in the area. She said <br /> she is concerned other people may have to go through the same problems <br /> she and her husband have endured. <br /> Barbara Rutledge, 2155 Edgehill Court, said all the earth movement will <br /> be directly below her house. She noted she had sent a letter, and she <br /> asked the City Council to vote against this project. <br /> Richard Biaggi , 1495 Montrose Drive, said he wondered if the Applicant <br /> knew what he was in for. He said there are many unknowns, such as the <br /> final soils report, siting work, etc. He said the City was putting the <br /> cart before the horse, and the City should not act on the subdivision <br /> of the property until the Applicant has an idea of what the costs will <br /> be. He said he thought the Applicant should find out what he must do <br /> before the project is approved. He noted he had to spend $95,000 re- <br /> doing the foundations of his house and said he would like to know more <br /> about what kind of controls would be imposed on the removal of earth, <br /> trees, hours of work, etc. He said it surprised him this would be the <br /> only time adjacent residents would be allowed to speak on this matter <br /> and felt it was preliminary. <br /> Mayor Karp noted if the lot was not subdivided the Applicant would <br /> still be able to build one home on the property without going before <br /> the City Council . He would simply have to get a Building Permit. <br /> Mr. Biaggi requested the City Council direct that each affected <br /> property owner in the area would receive, in writing, information on <br /> the hours of work, amount of dirt to be removed, dust controls, etc. <br /> Mayor Karp asked what controls could be imposed on a legal lot. Steve <br /> Meyers said if only a Building Permit is required on a legal lot, then <br /> only those controls in the Building Code may be imposed. He said there <br /> are already requirements in the City's Code related to dust control , <br /> removal of dirt, etc. <br /> Don Cook, 2155 Edgehill Court, said the engineering reports recommend <br /> that grading be done only in the dry months. He said that is an <br /> indication to him there may be problems if it rains during grading. He <br /> said the report states moist soil was found in the area, and that is an <br /> indication to him there is a spring on the property. He said grading <br /> in wet weather could cause other houses to slide. He said he has been <br /> involved in this type of project and has seen many hills slip out from <br /> under homes because of underground springs. He asked how there could <br /> be any moist soil after six years of drought. <br />
