Minutes - San Leandro City Council Meeting - August 17, 1992 Page - 13 - <br /> NEW BUSINESS (continued) <br /> better than when existing houses in the area were built. He said he <br /> understands the neighbors' concerns, but all the concerns have been <br /> considered and measures will be taken. He said the neighbors were <br /> concerned about wildlife; however, this property is in the middle of a <br /> couple of hundred houses. He said he did not feel it was fair to put <br /> a burden on him to take care of the wildlife for the area. He said, <br /> when he bought the house, he thought he had the protection of the <br /> Zoning Code. He said it would not be economically feasible to try to <br /> develop the site with one house. He said the property would have <br /> retaining walls at the driveway and cut areas. <br /> Mayor Karp said the public had been allowed to express their opinions <br /> as though this were a Public Hearing; however, he said the City cannot <br /> take economics of the situation into consideration. What was before <br /> them tonight was the matter of sub-dividing one parcel into two <br /> parcels. <br /> Council Member Kerr asked if the Applicant could build a single-family <br /> home without going through the Parcel Map process . Staff indicated he <br /> could under a standard Building Permit, and this matter was on the <br /> Council 's Agenda because the Applicant was sub-dividing the property. <br /> Mr. Silva reiterated that the grading details and the configuration of <br /> the lot would all be part of the Building Permit. He said the only <br /> thing the Parcel Map issue addressed was the issues related to sub- <br /> division of the land. In response to questions from the City Council , <br /> he said the City was rejecting the right-of-way dedication at this time <br /> because the City did not want to accept the right of way until all <br /> necessary improvements were constructed. He said, at that time, right- <br /> of-way dedication would be accepted. <br /> Council Member Faria said he had trouble certifying the Negative <br /> Declaration. <br /> Council Member Perry said she felt there were difficulties with the <br /> Negative Declaration related to slippage and drainage problems. She <br /> said it was hard to approve it with all the unknowns. <br /> • <br /> Mayor Karp noted it appeared to him that the slopes on the lot were <br /> from 25-27%. He said cutting into the hill would change the contours. <br />
