Minutes - San Leandro City Council Meeting - December 7, 1992 Page - 10 - <br /> PUBLIC HEARINGS (continued) <br /> Mr. Filipovich said the Washington Homeowners' Association tried to do <br /> something about this many years ago. He said the neighbors around the <br /> Church dropped out of the Association and are not represented by it. <br /> He said Council Member Kerr should not be participating in this <br /> Hearing. <br /> Steve Meyers, City Attorney, said Council Member Kerr had requested <br /> advice, and Mr. Meyers had advised him that he could participate. Mr. <br /> Filipovich said the Pastor and Church should have talked to him. <br /> There being no further comments from the public, on motion by Council <br /> Member Faria, seconded by Council Member Perry, and carried <br /> unanimously, the City Council closed the Public Hearing. <br /> Mayor Karp referred to a letter from Mr. Filipovich which said the fire <br /> at the School is not the issue; however, he said Mr. Filipovich spent <br /> 40 minutes discussing the fire. Mayor Karp said what is at issue is <br /> the Conditional Use Permit . He said this matter came before the Board <br /> of Zoning Adjustments when he was the Chairman in 1978. He said <br /> spending $2,500 every few years is a waste of the Church's money and <br /> the City's time. He said they have been exemplary and should be given <br /> a time limit and exempted from paying a fee in the future. <br /> Council Member Kerr said he can't find any specific complaints or <br /> evidence of adverse impacts on the neighbors. He said there is no <br /> reason for them to keep reapplying. <br /> The following Motion was then introduced: <br /> Minute.Order No. 92-80. Matter of Appeal by Lou Filipovich, Et Al . , of <br /> Board of Zoning Adjustments' Approval of CU-64-25 (9th Modification) ; <br /> Conditional Use; Modify Conditional Use Permit for Permanent Status for <br /> the Junior and Senior High School , Grades 7 Through 12, at Manor <br /> Baptist Church and School ; 1845 Lewelling Boulevard; Assessor's Parcel <br /> Number 80G-1321-154-7; R-1 (Single Family) District. (1098) <br /> On motion by Council Member Kerr, who moved its approval , seconded by <br /> Council Member Faria, and carried by the following called vote, the <br /> City Council denied the Appeal and granted permanent status to the <br /> Manor Baptist Church School , with no termination date, but with a <br /> compulsory review by staff every two years for compliance with the <br /> Conditions of Approval . <br /> AYES: Council Members Corbett, Faria, Kerr, Myers, Perry, Polvorosa; <br /> Mayor Karp ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br /> Council Member Corbett asked about the process, if there are violations <br /> of the Conditions. <br />
