Minutes - San Leandro City Council Meeting - December 7, 1992 Page - 10 - PUBLIC HEARINGS (continued) Mr. Filipovich said the Washington Homeowners' Association tried to do something about this many years ago. He said the neighbors around the Church dropped out of the Association and are not represented by it. He said Council Member Kerr should not be participating in this Hearing. Steve Meyers, City Attorney, said Council Member Kerr had requested advice, and Mr. Meyers had advised him that he could participate. Mr. Filipovich said the Pastor and Church should have talked to him. There being no further comments from the public, on motion by Council Member Faria, seconded by Council Member Perry, and carried unanimously, the City Council closed the Public Hearing. Mayor Karp referred to a letter from Mr. Filipovich which said the fire at the School is not the issue; however, he said Mr. Filipovich spent 40 minutes discussing the fire. Mayor Karp said what is at issue is the Conditional Use Permit . He said this matter came before the Board of Zoning Adjustments when he was the Chairman in 1978. He said spending $2,500 every few years is a waste of the Church's money and the City's time. He said they have been exemplary and should be given a time limit and exempted from paying a fee in the future. Council Member Kerr said he can't find any specific complaints or evidence of adverse impacts on the neighbors. He said there is no reason for them to keep reapplying. The following Motion was then introduced: Minute.Order No. 92-80. Matter of Appeal by Lou Filipovich, Et Al . , of Board of Zoning Adjustments' Approval of CU-64-25 (9th Modification) ; Conditional Use; Modify Conditional Use Permit for Permanent Status for the Junior and Senior High School , Grades 7 Through 12, at Manor Baptist Church and School ; 1845 Lewelling Boulevard; Assessor's Parcel Number 80G-1321-154-7; R-1 (Single Family) District. (1098) On motion by Council Member Kerr, who moved its approval , seconded by Council Member Faria, and carried by the following called vote, the City Council denied the Appeal and granted permanent status to the Manor Baptist Church School , with no termination date, but with a compulsory review by staff every two years for compliance with the Conditions of Approval . AYES: Council Members Corbett, Faria, Kerr, Myers, Perry, Polvorosa; Mayor Karp ( 7 ) NOES: None ( 0 ) ABSENT: None ( 0 ) Council Member Corbett asked about the process, if there are violations of the Conditions.
