Minutes - San Leandro City Council Meeting - December 7, 1992 Page - 7 - <br /> PUBLIC HEARINGS (continued) <br /> Mr. Weisbrod said the Board of Zoning Adjustments determined that, <br /> since there were so few students enrolled at the School and no <br /> complaints have been received by Community Standards, they were <br /> comfortable with giving a five-year extension. The Board noted the new <br /> homes on the old Marina High School site would be completed in five <br /> years, and this might have an impact on the Manor Baptist Church School <br /> enrollment. The Board attached a Condition to the approval that, if <br /> Manor Baptist sells or leases the property, any new operator of the <br /> School must come before the Board for a new Conditional Use Permit. <br /> Council Member Faria asked what the maximum enrollment has been. Mr. <br /> Weisbrod believed it had been as high as 250 students for a short <br /> period. He said there were no complaints during that period. <br /> Council Member Myers asked if Manor Baptist would be required to come <br /> back before the Board if any Conditions were violated. Mr. Weisbrod <br /> said the Board or the City Council can require a review any time the <br /> School is not in compliance with the Conditions. He said the <br /> Conditions would remain in effect during either a five-year extension <br /> or a permanent status. He said there would be no charge for a review <br /> of their compliance with the Conditions, but there is a charge for a <br /> modification or extension of the Permit. <br /> Council Member Kerr asked if the School has lived up to all the <br /> Conditions. Mr. Weisbrod said they have; he said the property is well <br /> maintained, there are not a lot of cars, and they do not use the back <br /> parking lot as a play area but have an agreement with Hope Lutheran <br /> Church to use their gymnasium. He said staff recommended permanent <br /> status to the BZA. <br /> Council Member Kerr asked, if the School received permanent status, <br /> could it come back any time there was a complaint. Mr. Weisbrod said <br /> Community Standards would request compliance, and if the School did not <br /> comply, it would be called up for a review. Council Member Kerr noted <br /> the BZA seemed to be concerned about future enrollment. Council Member <br /> Kerr asked if there were similar restrictions on other parochial <br /> schools. Mr. Weisbrod said the Conditions placed on other schools are <br /> specific to the sites and the impact of the schools on the surrounding <br /> areas. <br /> Council Member Corbett asked if there have been complaints about the <br /> School . Mr. Weisbrod said the City has no record of complaints during <br /> the three-year period of this extension. <br /> Council Member Perry asked if information was given to the neighbors on <br /> who to call with complaints; Mr. Weisbrod said it was. <br /> Mayor Karp noted that there were two letters opposing approval of the <br /> 9th Modification from Mrs. George Gagnon and Ms. Johanna MacMillan, and <br /> one letter supporting approval from Mr. and Mrs. Maurice R. McIntyre. <br />
