Minutes - San Leandro City Council Meeting - December 7, 1992 Page - 8 - <br /> PUBLIC HEARINGS (continued) <br /> Lou Filipovich, the Appellant, 15376 Laverne Drive, said this is the <br /> 9th modification. He said this is more than his 20th appearance before <br /> the City on this matter. He said he tried to put a document together <br /> for the BZA Hearing and another neighbor sent a FAX, but it was too <br /> late for him to submit his document at the BZA Hearing. He said one of <br /> the BZA members was not present at the Hearing, but he had stated that <br /> he would not support permanent status. He said the BZA went for five <br /> years, and the City Council could change the approval . He said there <br /> have been complaints about conditions between the School and the <br /> neighbors, but the Conditions of Approval are between the City Council <br /> and the Church -and have nothing to do with properties in the area. He <br /> said it is not the neighbors' intention to be policemen and see that <br /> the Conditions are met. <br /> Mr. Filipovich said complaints were supposed to go to Mr. Weisbrod. He <br /> referred to a document he had prepared and to a number of newspaper <br /> articles. He said, without the School there never would have been a <br /> fire, and issues still remain as to the aftermath of the fire and how <br /> it is being handled by the Church and School management. He noted the <br /> newspapers said police had talked to neighbors after the fire, but he <br /> said he talked to 15 neighbors and none of them had been contacted by <br /> the police. He said the newspapers said there was someone offering a <br /> reward if they could prove a neighbor had set the fire, then the <br /> newspapers said the fire had been set as a hate crime, and also said it <br /> was set by someone with a vendetta. He said it is obvious the School <br /> has been a problem for the Church members because they have been <br /> fighting about it for years and enrollment is dropping. He said the <br /> Church agreed not to press charges if Mr. Ragan paid $50 per week, yet <br /> the School is supposed to be teaching children right and wrong. He <br /> said, in this day and age city government cannot afford to issue <br /> permanent status without assuming some liability. He asked who would <br /> have been liable if the fire had spread to adjacent properties. He <br /> said five-year or permanent status is ridiculous. He said the School <br /> should be given a one- or two-year extension or remain status quo, <br /> which will not affect the School but will make it self-policing and <br /> give the neighbors peace of mind. <br /> Council Member Kerr asked how the School adversely impacts Mr. <br /> Filipovich's property, or his neighbors or their property, not how the <br /> School operates its business. Mr. Filipovich said a few years ago he <br /> and some of his neighbors had problems with their insurance. He said <br /> the noise doesn't bother him but does bother some of the neighbors. He <br /> said the letter in support of the School was from someone who does not <br /> live in the area. He said the neighbors gave up coming to Hearings a <br /> long time ago. <br /> Council Member Kerr said he would like to pinpoint some solid <br /> complaints. Mr. Filipovich said the City Council should talk to the <br /> neighbors. He said the problems are not the same as they used to be. <br /> He said there used to be a lot of junk, but it has been moved. He said <br /> everyone is trying to accommodate the School , not the neighbors. <br />
