Matter of A-89-10; Amendment; to Amend Zoning Code to Establish an IS <br /> (Interim Study) Overlay District to Provide for Review of Development <br /> Activity in Areas Undergoing Special Study Regarding Appropriate Land <br /> Use and/or Development Standards; City Council Resolution of Intention <br /> No. 10-26-89. <br /> Mr. Vitz explained that the IS zoning designation requires that prior <br /> to or simultaneously with the reclassification of land to an IS Overlay <br /> District, the Planning Commission and the City Council must approve a <br /> study plan for the area to be so zoned. He said that once the IS <br /> District is established, a use permit is required for new or expanded <br /> uses within the area and for any approval of the use a finding must be <br /> made that the proposed use does not fall within the scope of the land- <br /> use development issues being resolved for the Study Area. <br /> Council Member Corbett asked for a further explanation of the paragraph <br /> in the staff report related to findings. Mr. Vitz gave an example of <br /> a requirement for findings: If a study were being conducted on a site <br /> regarding the appropriateness of light uses and an applicant desired to <br /> construct heavy industrial uses, the heavy industrial use would be an <br /> issue and could be delayed or turned down based on the IS zoning. He <br /> said this places another level of review on zoning applications. <br /> Council Member Faria asked how an area becomes IS and whether an area <br /> could be studied without designating it IS. Mr. Vitz said the <br /> recommendation to designate an area IS would go through the Planning <br /> Commission to the City Council and that the designation might be <br /> appropriate for some areas, for example, the Peralta Area, while not <br /> appropriate for others, such as the Marina area. <br /> C. Matter of A-90-1; Amendment; to Amend Zoning Code to Establish an OS <br /> (Open Space) District to Be Used for Areas in the City Designated <br /> Permanently as Open Space for Recreation or Environmental Protection <br /> Purposes; City Council Resolution of Intention No. 3-29-90. <br /> Mr. Vitz explained that many of San Leandro's shoreline and off-shore <br /> areas are currently zoned CR (Commercial Recreation) which is not <br /> appropriate zoning. He said the CR District permits parks and open space <br /> but also permits a variety of commercial activities such as marinas, golf <br /> courses, restaurants, etc. He said the proposed OS designation would <br /> help bring the Zoning Code into closer conformance with the General Plan. <br /> He said the OS designation limits the types of activities that would be <br /> permitted in these zones. He said the CR zoning would continue to apply <br /> on the Marina and golf course areas but the proposed OS zoning might be <br /> placed on such areas as the southwest area of the City on the City and <br /> State Lands holdings, adjacent to the shoreline. He said the OS <br /> designation would provide a suitable classification for large public or <br /> private sites which are permanently designated for park or open space. <br /> Dick Randall , City Manager, noted that the new Zoning Code also includes <br /> a PS (Public and Semi -Public) designation which would be applied to areas <br /> such as school sites. <br />
