Minutes - San Leandro City Council Meeting - January 16, 1990 Page - 3 - <br /> PUBLIC HEARINGS: <br /> a. Matter of CU-64-25 (8th Modification); Modify Conditional Use; Request for <br /> Five (5)-Year or Permanent Status for Junior and Senior High School Grades <br /> 7 through 12 at Manor Baptist Church and School ; 1845 Lewelling Boulevard; <br /> Assessor's Parcel Number 80-G-1321-154-7; R-1 (Single Family) District -- <br /> Appeal . <br /> This being the time and the place for the Public Hearing on the above matter, <br /> Gaye Quinn, Acting City Planner, explained that this was an Appeal of a Board <br /> of Zoning Adjustments' action. She said the Board of Zoning Adjustments' <br /> action had provided five-year status for the Junior and Senior High School <br /> at Manor Baptist Church and Mr. Filipovich was appealing this matter, based <br /> on the impact this school has on his ability to obtain liability insurance. <br /> She said the original approval for the Junior and Senior High School was <br /> given in 1987 for one year and two additional one-year extensions were <br /> approved and the school was now asking for a five-year extension. She said <br /> the Board of Zoning Adjustments recommended that the City Council uphold <br /> their action because the current enrollment is under that which is allowed <br /> and the current administration is meeting all of the Conditions of Approval . <br /> The City Council asked questions regarding any complaints received, the <br /> maintenance of the site, Conditions of Approval , and Conditional Uses for <br /> schools. <br /> The hearing was then opened to the public. <br /> Mrs. Mary Murray, 1845 Lewelling Boulevard, the Applicant for the Conditional <br /> Use, said the Board of Zoning Adjustments has approved the request and the <br /> School has complied with all conditions. <br /> Lou Filipovich, 15376 Laverne Drive, the Appellant, gave background on the <br /> School . He said the neighborhood is not against schools but they do not like <br /> having one in their immediate vicinity. He said he felt that approvals on <br /> a one-year basis were self-policing actions of the Conditions of Approval <br /> and a five-year extension would be too long. He said he felt a two-year <br /> approval of the status for the Schools was sufficient. <br /> The City Council asked questions regarding any complaints he or the neighbors <br /> might have. He said there were no problems now. The City Council asked <br /> further questions related to the types of controls the City has in enforcing <br /> Conditions of Approval . <br /> There being no further comments from the public, on motion of Council Member <br /> Santos, seconded by Council Member Perry and carried unanimously, the Public <br /> Hearing was closed. <br /> On motion of Council Member Glaze, seconded by Council Member Faria and <br /> carried unanimously, the City Council denied the Appeal and upheld the Board <br /> of Zoning Adjustments' recommendations, with the modification that the <br /> approval of a five-year extension be reduced to a three-year extension. <br />
