• <br /> Minutes - San Leandro City Council Meeting - March 19, 1990 Page - 4 - <br /> PUBLIC HEARINGS (continued) <br /> c. Matter of Notice of Intent to Adopt Condemnation Resolution, 1234 Orchard <br /> Avenue, Thrasher Park Master Plan (authorizes City to acquire subject <br /> properties by eminent domain). <br /> This being the time and place for the Public Hearing on the above matter, <br /> Rob Caughell , Community Development Department, explained that this <br /> Resolution of Necessity provides for the acquisition of the last piece of <br /> property on Orchard Avenue necessary for completion of the Thrasher Park <br /> Master Plan. He said it is approximately 5,000 square feet, occupied by a <br /> single-family home, and the City cannot come to an agreement with the <br /> property owner related to the purchase price so was requesting this <br /> Resolution of Necessity in order to allow condemnation proceedings to occur. <br /> The Hearing was then opened to the public. <br /> Dan Ryan, 4307 Octavia, Castro Valley, representing the owner, and Mrs. <br /> Pennington, the property owner, spoke before the City Council . They said <br /> they are disputing the appraisal price. <br /> Steve Meyers, City Attorney, said the purpose of tonight's Hearing is to <br /> determine if the City will acquire the property and has nothing to do with <br /> the cost, that if agreement cannot be reached on the cost, it would be a <br /> matter to go before the courts. <br /> The City Council asked how far apart the City and the property owner are in <br /> relationship to the purchase price. The City Council also asked the property <br /> owner how long she had owned the property, whether she was aware of the <br /> Master Plan of City Streets, and whether she was aware that other homes had <br /> been sold in connection with this project. Mayor Karp told the property <br /> owner that the City will go out of its way to be fair and requested that <br /> staff work with Mrs. Pennington. <br /> There being no further comments from the public, on motion of Council Member <br /> Suchman, seconded by Council Member Perry, and carried unanimously, the <br /> Public Hearing was closed. <br /> The following Resolution was then introduced: <br /> RESOLUTION NO. 90-34 (1885) <br /> RESOLUTION OF NECESSITY AUTHORIZING THE ACQUISITION <br /> OF CERTAIN PROPERTY FOR THE DEVELOPMENT OF THRASHER PARK <br /> AND FINDING THAT THE PUBLIC INTEREST <br /> AND NECESSITY REQUIRE THE PROPOSED PROJECT, <br /> THAT THE LOCATION THEREOF CAUSES THE LEAST PRIVATE <br /> INJURY, THAT THE SUBJECT PROPERTY IS NECESSARY FOR <br /> THE PROPOSED PROJECT <br />• <br /> Introduced by Council Member Faria who moved its adoption, seconded by Council <br /> Member Santos and carried by the following called vote: <br /> AYES: Council Members Faria, Glaze, Jardin,' Perry, Santos, Suchman; <br /> Mayor Karp ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br />
