Minutes - San Leandro City Council Meeting - April 16, 1990 Page - 12 - PUBLIC HEARINGS (continued) : The Hearing was then opened to the public. Glen Forbes, attorney representing the Applicant, noted that there have been three years of work between staff and the Applicant. He said when this property was originally rezoned the owner said he would agree to the rezoning only if he could maintain the 8-foot setback instead of the 20-foot setback. He said in 1987 the building burned down and the property owner was asking that the 8-foot setback still be permitted. He said the property owner had then asked for a reclassification back to I-2 but the Rezoning Application had been tabled so that the Applicant and staff could further work on this matter. He said the recommendation had been made by staff to the Planning Commission to permit the 8-foot setback but the Planning Commission had recommended 20 feet. The City Council asked a number of questions related to the Conditions of Approval . There being no further comments from the public, on motion of Council Member Suchman, seconded by Council Member Faria and carried unanimously, the Public Hearing was closed. On motion of Council Member Santos, seconded by Council Member Suchman and carried unanimously, the City Council approved the Planning Commission recommendations, with the following modifications to the Conditions of Approval : (1) Item I .A. -- Changed setback requirement from 20' to 8' . (2) Item I .C. -- Changed setback requirement from 20' to 8' . (3) Item III .A. 1 .b -- Modified to read: "A trucking repair and maintenance facility may occupy Subunit I provided the area of the building and site does not exceed the 2,600 feet occupied prior to the fire in 1987 and the operations related thereto are not visible from any public street. Storage of trucks and trailers on the site is not permitted. All outdoor storage uses shall comply with the requirements of the I-P District.
