Minutes - San Leandro City Council Meeting - April 16, 1990 Page - 12 - <br /> PUBLIC HEARINGS (continued) : <br /> The Hearing was then opened to the public. <br /> Glen Forbes, attorney representing the Applicant, noted that there have been <br /> three years of work between staff and the Applicant. He said when this <br /> property was originally rezoned the owner said he would agree to the rezoning <br /> only if he could maintain the 8-foot setback instead of the 20-foot setback. <br /> He said in 1987 the building burned down and the property owner was asking <br /> that the 8-foot setback still be permitted. He said the property owner had <br /> then asked for a reclassification back to I-2 but the Rezoning Application <br /> had been tabled so that the Applicant and staff could further work on this <br /> matter. He said the recommendation had been made by staff to the Planning <br /> Commission to permit the 8-foot setback but the Planning Commission had <br /> recommended 20 feet. <br /> The City Council asked a number of questions related to the Conditions of <br /> Approval . <br /> There being no further comments from the public, on motion of Council Member <br /> Suchman, seconded by Council Member Faria and carried unanimously, the Public <br /> Hearing was closed. <br /> On motion of Council Member Santos, seconded by Council Member Suchman and <br /> carried unanimously, the City Council approved the Planning Commission <br /> recommendations, with the following modifications to the Conditions of <br /> Approval : <br /> (1) Item I .A. -- Changed setback requirement from 20' to 8' . <br /> (2) Item I .C. -- Changed setback requirement from 20' to 8' . <br /> (3) Item III .A. 1 .b -- Modified to read: "A trucking repair and maintenance <br /> facility may occupy Subunit I provided the area of the building and site <br /> does not exceed the 2,600 feet occupied prior to the fire in 1987 and <br /> the operations related thereto are not visible from any public street. <br /> Storage of trucks and trailers on the site is not permitted. All <br /> outdoor storage uses shall comply with the requirements of the I-P <br /> District. " <br /> ORDINANCES PASSED TO PRINT: <br /> ORDINANCE NO. 90-09 (1413) <br /> AN ORDINANCE AMENDING SECTION 8-1-310 OF <br /> TITLE VIII, CHAPTER 1 OF THE SAN LEANDRO MUNICIPAL <br /> CODE RELATING TO CITATIONS; VIOLATIONS <br /> Introduced by Council Member Faria who moved that it be passed to print, seconded <br /> by Council Member Santos, and carried by the following called vote: <br /> AYES: Council Members Faria, Glaze, Jardin, Perry, Santos, Suchman; <br /> Mayor Karp ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br />
