Public Hearing of Protests Relative to Resolution of Intention to Order <br /> Certain Public Improvements. <br /> - See Resolutions Below. <br /> This being the time and place for the Public Hearing on the above matter, <br /> Steve Meyers, City Attorney, noted that these Public Hearings would hear <br /> all matters related to Assessment District No. 99. <br /> He said on April 16, 1990, City Council had adopted Resolution No. 90-62, <br /> Resolution of Intention to Form the Assessment District. The required notice <br /> had been given to property owners and all other requirements of law related <br /> to Public Hearings had been met. <br /> He said there were two Public Hearings that would be heard concurrently on <br /> the City Council 's Agenda on this matter: The Public Hearing on Whether the <br /> Public Convenience and Necessity Require the Ordering of Proposed <br /> Improvements Without First Complying with the Provisions of the Special <br /> Assessment Investigation, Limitation and Majority Protest Act of 1931 and <br /> the Public Hearing of Protests Relative to Resolution of Intention to Order <br /> Certain Public Improvements. <br /> He then described presentations to be given by members of City staff and <br /> others associated with the Assessment District. He said that anyone <br /> objecting to the Assessment District is entitled to file a written protest <br /> with the City Council . He said at the end of the Public Hearing staff would <br /> request a recess to calculate the protests. <br /> John Jermanis, City Finance Director, displayed overhead slides to illustrate <br /> his presentation. He said the proposed Assessment District involves <br /> properties on Marina Boulevard and portions of Alvarado and Teagarden Streets <br /> and the involved properties would be required to pay for a portion of the <br /> costs involved in undergrounding utilities. He said the process provides <br /> a mechanism for the assessed property owners to make their payments over <br /> time. He noted the City of San Leandro does have an undergrounding ordinance <br /> in place that requires all properties involved in the Underground Master Plan <br /> to pay a base fee of $110 per lineal foot when the property is developed. <br /> He then summarized the assessments involved in this Assessment District. <br /> He said a pre-payment amount of $110 per lineal foot had been developed in <br /> keeping with the provisions of the Municipal Code, and each parcel for which <br /> that pre-payment amount was paid by the May 14 deadline had been excluded <br /> from the assessment district. Fourteen parcels had been excluded on that <br /> basis by reducing the recommended assessment on each such parcel to zero, <br /> as shown on Exhibit C of the Engineer' s Report. For those parcels remaining <br /> in the assessment district, the assessment amounts represented the $138 per <br /> lineal foot, with the $28 additional cost representing the cost and expense <br /> associated with implementing the assessment district and the related bond <br /> financing. He said that, once the assessments are recorded as liens upon <br /> the respective parcels, property owners will have a 30-day period within <br /> which to discharge the liens at a rate of $126 per lineal foot, a rate which <br /> excludes the pure bond financing costs. <br />
