Minutes - San Leandro City Council Meeting - July 2, 1990 Page - 13 - <br /> RESOLUTIONS (continued) <br /> this is the beginning of the process to consider rezoning. He also said that <br /> cooperation is necessary between the City, the landowner and the other agencies <br /> having jurisdiction over this project in order to develop a Habitat Management <br /> Plan. <br /> Council Member Santos spoke at length regarding an article in the Daily Review <br /> which referred to this area as a dredging dump. He said the article was <br /> misleading and inaccurate. He said the City must go through a detailed permit <br /> process before depositing dredge spoils, and all decant water must be tested. <br /> He said that to allude to the area as a dump is not accurate or true. He said <br /> the newspaper stated that the subject agreement was necessary for the City to <br /> start the process of allowing development on the property. He said this is not <br /> true and the Resolution has nothing to do with construction on the property. He <br /> said the facts must be laid out before the City Council so they can address this <br /> issue and he said he felt it was unfair on the part of the Daily Review to print <br /> an abrasive, inaccurate article. <br /> The motion was then made by Council Member Santos, seconded by Council Member <br /> Polvorosa to adopt the subject Resolution. The Mayor then opened the floor to <br /> public comments. <br /> Barbara Shockley, 1890 Bockman Road, San Lorenzo, spoke representing CALM <br /> (Citizens for Alameda's Last Marshlands) . She said they are pleased with the <br /> reception they have had when they want to engage in planning for this area. <br /> She requested that the City Council withhold approval of the agreement. She said <br /> that option in the agreement provided for specific decisions to be made. She <br /> spoke regarding concurrent executions of agreements related to purchase price <br /> for the dredge disposals area and said this takes action related to the property. <br /> She said CALM believed there were questions of legality and that public notice <br /> should have been given, a review period provided, and this agreement should not <br /> have been prepared prior to preparation of an EIR. She said the Preliminary <br /> Memorandum of Understanding (PMOU) sets future rezoning in place and she urged <br /> the City Council to circulate the PMOU. <br /> Steve Meyers, City Attorney, said the City usually initiates rezoning under a <br /> Resolution of Intention which requires no public notice but directs staff and <br /> the Planning Commission to study rezoning to conform to the General Plan. He <br /> said when rezoning comes before the Planning Commission, substantial public <br /> notice is given. This agreement is simply an initiation of the process leading <br /> to environmental review and possible rezoning. He said the option in this <br /> agreement represents the present ability of the City to acquire property, not <br /> the intention. He said it will necessary to complete an EIR and a consultant <br /> will be retained for this purpose. <br /> Jeff Houston, 1465 Burkhart Avenue, San Leandro, said he spends a lot of time <br /> at the Roberts' Landing area, seeking escape from the pressures of his job. He <br /> asked how many people in the audience did not want homes built there. The Mayor <br /> referred to an overhead presentation and discussed ownership of the various <br /> parcels of property involved. <br />
