The agency may impose <br />such other reasonable restrictions as are nec- <br />essary to protect the development and uses <br />in the project area. (Ord. 99-025 § 304, <br />1999) <br />3.36.050 Interim uses. <br />The agency is authorized to use or permit <br />the use of any real property in the project <br />area, pending its ultimate development pur- <br />suant to the plan for interim uses that do not <br />conform to the uses permitted in the plan. <br />Such interim uses shall comply with all ap- <br />plicable city codes. (Ord. 99-025 § 305, <br />1999) <br />3.36.060 Nonconforming uses. <br />The agency is authorized to permit an <br />existing use that does not conform to the <br />provisions of the plan to remain in an exist- <br />ing structure that is in good condition, pro- <br />vided that such use is generally compatible <br />with existing and proposed developments <br />and uses in the project area and abatement of <br />such nonconforming use is not required by <br />applicable city codes. The agency may au- <br />thorize additions, alterations, repairs or other <br />improvements to nonconforming properties <br />when the agency determines that such re- <br />pairs or improvements would be compatible <br />with surrounding uses and are permitted un- <br />der applicable city codes. <br />The agency may require the owner of a <br />nonconforming property to record a cove- <br />nant imposing reasonable restrictions on the <br />property, as the agency deems necessary to <br />protect the project. (Ord. 99-025 § 306, <br />1999) <br />4AMI 11 <br />3.36.070 Conforming uses. <br />The agency may, at its sole and absolute <br />discretion, determine that some properties <br />within the project area already meet the re- <br />quirements of the plan. The agency may is- <br />sue certificates of conformance for such <br />properties, evidencing that the owners may <br />remain as owners of conforming properties <br />without entering into a participation agree- <br />ment with the agency, so long as such own- <br />ers continue to operate, use, and maintain <br />such properties in conformity with the plan. <br />The agency may require the owner of a <br />conforming property to enter into a partici- <br />pation agreement if the owner wishes to (1) <br />construct any additional improvements or <br />substantially alter or modify existing struc- <br />tures on such conforming property; or (2) <br />acquire additional property within the pro- <br />ject area. (Ord. 99-025 § 307, 1999) <br />3.36.080 General controls and <br />limitations. <br />All real property in the project area is <br />made subject to the controls and require- <br />ments of the plan. No real property shall be <br />developed, rehabilitated, or otherwise im- <br />proved after the effective date of the ordi- <br />nance adopting the plan except in conform- <br />ance with the provisions of the plan. (Ord. <br />99-025 § 308, 1999) <br />3.36.090 Construction controls. <br />All construction undertaken in the project <br />area shall comply with applicable state and <br />local laws and regulations. The agency may <br />adopt additional performance and develop- <br />ment standards to control and direct con- <br />struction in the project area, including prop- <br />erty rehabilitation standards and design <br />standards.
