11Ai1Z1=1 <br />to such improvements adopted by the rede- <br />velopment agency; or <br />2. Entered into an owner participation <br />agreement providing for such improve- <br />ments. <br />C. Any change in use or occupancy, any <br />lease renewal, or other agreement providing <br />for continuing occupancy by an existing oc- <br />cupant or new occupant, or any unauthor- <br />ized construction activity initiated without <br />approval of the agency shall be a misde- <br />meanor. <br />D. No business license shall be issued to <br />any business within the project area which is <br />not in compliance with this plan. <br />E. Any lease or other agreement provid- <br />ing for continuing occupancy by an existing <br />occupant or new occupant, executed in vio- <br />lation of these provisions shall be voidable <br />at the option of the lessee. <br />F. In the event of failure of an owner to <br />fully comply with the provisions of an own- <br />er participation agreement into which owner <br />has entered. with the agency, the agency <br />may thereupon, by motion, declare void all <br />occupancy approvals granted by agency in <br />said agreement. Continued occupancy of the <br />premises thereafter by such occupants is a <br />violation of this plan. (Plaza 2 redev. plan § <br />12(B),1988) <br />1.40.030 Owner participation <br />agreements. <br />Owner participation agreements will be <br />prepared as soon after the adoption of the <br />redevelopment plan as possible. Such <br />agreements will be prepared by the redevel- <br />opment agency after consultation with prop- <br />erty owners. Each agreement will contain a <br />list of minimum improvements to be made <br />to the specific property to which it applies, <br />formulated in accordance with the standards <br />(San Leandro Redevelopment Agency Supp. No. 2, 12-05) 50 <br />and design concept established hereunder. In <br />addition, each agreement will provide for <br />the submission to the agency of specific plan <br />and specifications for these improvements <br />sufficiently in advance of the time at which <br />the improvements are actually to be accom- <br />plished to permit thorough agency review. <br />The time at which improvements to a build- <br />ing and site are to be accomplished will, <br />when necessary, be coordinated with the <br />lease period of its major occupant. In those <br />cases with prolonged periods of time re- <br />maining on the current lease, earlier dates <br />will be established by the agency. (Plaza 2 <br />redev. plan § 12(C), 1988) <br />1.40.040 Standards. <br />All improvement plans presented to the <br />redevelopment agency and all actual im- <br />provements shall conform to the standards <br />adopted by the agency on August 14, 1967, <br />as part of the rules and standards governing <br />owner participation, and any subsequent <br />amendments thereto. <br />The agency may approve a variance from <br />the improvement standards on a showing by <br />the owner that the extent of recent im- <br />provements, the location or orientation of <br />the building, or the nature of a proposed use <br />of the building are such that strict adherence <br />to all improvement standards would serious- <br />ly and adversely affect the operation of such <br />use. (Plaza 2 redev. plan § 12(D), 1988) <br />1.40.050 Alternate provisions on <br />failure of owner to <br />participate. <br />In the event of failure of the owner to <br />participate in accordance with the owner <br />participation provisions of the plan, the re- <br />development agency may acquire the prop- <br />erty through eminent domain or as otherwise <br />
