(1) Replacing Truck with a new Reserve Truck; <br /> (2) Extending the term of this Agreement; <br /> (3) Modifying this Agreement to include as a Party other <br /> jurisdictions that contract with the ACFD for fire protection services; and <br /> (4) Such other issues relating to the Agreement as any Party <br /> may desire to evaluate. <br /> C. Termination. <br /> (1) By Sale of Truck. This Agreement may be terminated by <br /> the sale of Truck pursuant to Sections 3.C.4 and 3.C.5 of this Agreement. <br /> (2) Due to Termination or Expiration of Fire Service and <br /> Emergency Response Agreements. The Dublin/ACFD Agreement is currently <br /> scheduled to expire on June 30, 2002. The San Leandro/ACFD Agreement is <br /> currently scheduled to expire on January 1, 2000. While the Parties anticipate that <br /> these agreements may be extended, in the event that either or both agreements expire <br /> prior to the expiration of the term of this Agreement, then the Fire Truck shall be <br /> sold pursuant to Section 3.C.5. of this Agreement and this Agreement shall <br /> automatically terminate after such sale. <br /> (3) Due to Accident that "Totals" Truck. If an accident occurs <br /> that completely destroys Truck or otherwise renders Truck permanently unusable, <br /> following the distribution of insurance proceeds, Truck may be salvaged pursuant to <br /> Section 10.D of this Agreement. <br /> D. Salvage. Upon expiration of this Agreement, or any other event <br /> which causes Truck to stop serving as a Reserve Truck, ACFD shall, within fifteen <br /> (15) days, publish notice in a public agency or fire department trade publication <br /> inviting sealed bids to purchase Truck. Such notice shall be posted once at least <br /> fifteen (15) days before the opening of the bids and shall summarize any terms and <br /> conditions of the proposed sale. At the time and place set in the notice for the sale, <br /> ACFD shall publicly open and examine all the bids. ACFD shall then declare which <br /> bids conform to all the terms and conditions of sale. From among those conforming <br /> bids, ACFD shall sell Truck to the highest bidder. Notwithstanding the procedures in <br /> this Section 10.D., any Party may, within five (5) business days of the conclusion of <br /> the public opening and examination of the bids, order that the Truck shall not be sold <br /> to the highest conforming bidder and that the notice inviting sealed bids shall be <br /> Agreement Between City of Dublin, City of San Leandro and Page 8 of 12 <br /> ACFD Regarding Joint Ownership of a 1994 LTI Truck March 10, 1999 <br />
