<br />Planning Division is in conformity with the goals set forth in Subsection C.1. <br />of this Section. <br /> <br />I.F. Conditional Use Permits Applications. <br /> <br />The wireless telecommunications facilities listed as “CUP” in Table 1 are deemed to <br />be allowed by a Conditional Use Permit approval in certain zoning districts. New <br />monopoles and towers are allowed with a Conditional Use Permit in the CN, CC, CS, <br />CR, C-RM, P, PHD, NA-1, NA-2, SA-1, SA-3, DA-1, DA-2, OS and PS Districts. Archi- <br />tecturally-integrated antennas are allowed with a Conditional Use Permit approval <br />in the RS, RO, RD, and OS Districts. Wireless telecommunications facilities co- <br />located on existing tower structures are allowed with a Conditional Use Permit ap- <br />proval in the RS, RO, RD, DA-3, DA-4, and OS Districts. Conditional Use Permits <br />shall be reviewed and approved by the Board of Zoning Adjustments. Conditional <br />Uses shall comply with the general requirements of Subsection F, “Specific Design <br />Criteria, Subsections J.10 to J.12” as well as building permit requirements. <br /> <br />a. The Planning Division shall respond to each Conditional Use Permit application <br />within thirty (30) days after deeming the application complete. If the Planning <br />Division fails to respond to the applicant within thirty (30) days, then the appli- <br />cation shall be deemed to be approved. <br /> <br />b. If a Conditional Use Permit application is denied by the Board of Zoning Ad- <br />justments, it may be appealed to the City Council. <br /> <br />1. General. The following provisions shall govern the issuance of conditional use <br />permits: <br /> <br />a. If the tower or antenna is not a permitted use under Subsection 4 of this <br />Section or permitted to be approved administratively pursuant to Subsection <br />E of this Section, then a conditional use permit shall be required for the con- <br />struction of a tower or the placement of an antenna in all zoning districts. <br /> <br />b. In granting a conditional use permit, the Board of Zoning Adjustments may <br />impose conditions to the extent it concludes such conditions are necessary <br />to minimize any adverse effect of the proposed tower on adjoining proper- <br />ties. <br /> <br />c. Any information of an engineering nature that the applicant submits, whether <br />civil, mechanical, or electrical shall be certified by a licensed professional <br />engineer. <br /> <br /> <br />Exhibit G: Proposed Amended Article16 Page 61 <br />Note: underline and bolded text represents new text; strike-through text represents text to be eliminated
