<br /> <br />Section 4. Hours of Work <br /> <br /> A work week shall be computed as the number of hours customarily considered as a full <br />week's work in the classification and in the department in which the person is employed. <br /> <br /> The setting of work hours is based upon the operational needs of the department. An <br />employee’s work hours may be changed based upon the operational needs of the <br />department. In the event an employee’s work schedule is to be changed; the employee <br />shall be given seven (7) working days advance notice. <br /> <br />Section 5. Overtime Compensation <br /> <br /> Except as otherwise noted, the City’s official work period is 12:00 a.m. Sunday through <br />11:59 p.m. Saturday. Overtime is authorized time of five (5) minutes or more worked in <br />excess of forty (40) hours in a designated seven (7) day work period in the classification <br />and/or in excess of eight (8) hours (or the regularly scheduled work day if longer than (8) <br />hours) in the department in which the person is employed. Unless initiated/requested by an <br />employee, no employee's scheduled work period will be changed to avoid paying overtime. <br /> <br /> When first authorized by the department head and with approval of the City Manager, <br />overtime worked shall be paid at the rate of one and one-half (1½) times the hourly rate <br />based on the employee's monthly salary. For required call-out on a normal work day, a <br />minimum two (2) hours' pay at the overtime rate will be paid for the first such call-out. For <br />required call-out on a normal day off, a minimum two (2) hours' pay at the overtime rate will <br />be paid for each of the first two (2) such call-outs. It is understood that a telephone call <br />made to an employee during non-working hours which does not result in a call out of that <br />employee, shall not qualify for payment pursuant to this section. This time off must be taken <br />no later than the calendar year following the calendar year in which it was accrued and at a <br />time specifically approved by the supervisor. Except as herein above, a full-time regular <br />employee who is required to work on a holiday at the direction of his/her department head, <br />shall receive his/her pay for the holiday plus one and one-half (1½) times his/her regular pay <br />for the time worked. <br /> <br /> An employee may elect to take compensatory time off in an amount equal to one and one- <br />half (1½) times the overtime worked in lieu of pay. Compensatory time may be used, and <br />replaced, without regard to frequency of use, as long as the account balance does not <br />exceed 80 hours. <br /> <br /> In the event an employee is ordered by a magistrate to appear in court and does appear on <br />a day during which the employee has called in sick, the employee will be paid overtime at <br />the rate listed for court appearance, except that employees working the day shift shall not <br />be paid overtime, but the hours spent at the court appearance shall not be deducted from <br />his/her accumulated sick leave hours. <br /> <br />Upon promotion out of the Confidential group or other movement to a different employee <br />group or bargaining unit within the City, any unused, accrued time or comp time remaining <br />in the employee’s leave bank/s shall be paid off at the rate of pay which immediately <br />preceded the promotion or reassignment. <br /> <br /> <br /> <br />4 <br />SL Confidential EE Comp Plan 15-20 final
